Parents consuming or giving away food belonging to their children

Q: My daughter is a small baby and doesn’t have her teeth yet. Recently, someone sent some sweets for her as a present. However, due to her age, she cannot eat the sweets and by the time she is old enough to eat them, the sweets will be expired. What should I do with the sweets? Is it permissible for me to eat them or give them to others?

Bismillaah

A: You may purchase the sweets from your child by paying the equivalent value of the sweets, and thereafter you may do with the sweets as you please.

( وبيع الأب مال صغير من نفسه جائز بمثل القيمة وبما يتغابن فيه) وهو اليسير وإلا لا وهذا كله في المنقول أما في العقار فسيجيء (الدر المختار 6/709)

قال العلامة ابن عابدين – رحمه الله -: قوله: (وبيع الاب الخ) مثله: ما إذا باعه من أجنبي فثلاث صور في حكم واحد، وهي بيع الاب من نفسه أو من أجنبي، وبيع الوصي من أجنبي ط.
قلت: وهذا لو الاب عدلا أو مستورا، فلو فاسدا ففي بيعه المنقول روايتان كما سيأتي والشراء كالبيع. وقال في جامع الفصولين: للاب شراء مال طفله لنفسه بيسير الغبن لا بفاحشة اه. وفيه: لو باع ماله من ولده لا يصير قابضا لولده بمجرد البيع، حتى لو هلك قبل التمكن من قبضه حقيقة هلك على الولد، ولو شرى مال ولده لنفسه لا يبرأ عن الثمن حتى ينصب القاضي وكيلا لولده يأخذ الثمن ثم يرده على الاب ويتم البيع بقوله: بعت من ولدي ولا يحتاج إلى قوله: قبلت، وكذا الشراء، ولو وصيا لم يجز في الوجهين ما لم يقل: قبلت، وجاز للاب لا لوكيله ولا للوصي بيع مال أحد الصغيرين من الآخر.ولو وكل الاب وكيلين بذلك جاز، وفي بيع القاضي ذلك خلاف، ولو وكل الاب رجلا ببيع ماله من طفله أو الشراء منه لم يجز إلا إذا كان الاب حاضرا، ولم يجز للقاضي بيع مال اليتيم من نفسه وعكسه، إذ الجواز من القاضي على وجه الحكم ولا يجوز حكمه لنفسه، بخلاف ما شراه من وصيه أو باعه من اليتيم وقبل وصيه فإنه يجوز لو وصيا من جهة هذا القاضي اه.مخلصا (رد المحتار 6/709)

About 2 years ago I had very severe problems with doubts in taharah and salat. AlhamduLillah, these times are far away, and I feel myself much more comfortable. But unfortunately now I suffer from some new doubts which appeared recently. The first problem is regarding materials which doesn’t penetrate water. Before wudhu I’m in doubt whether there are some of them on my heels and near nails. For example, if I have few yarns stuck to my heels, I don’t know whether they are synthetic ones (which don’t penetrate water) or not. Because there are just a few yarns, I can’t advocate whether they penetrate water or not. Also sometimes I find hair stuck to my nails or heels, and again I’m in doubt whether it penetrates water or not. Also if I have some dirt, I’m also in doubt whether it contains some small amount of water-not-penetrating materials. So, my wudhu becomes quite a long procedure, where I try to look at my heels and nails thoroughly trying to remove all the dirt, yarns, stuck pieces of hair. The second problem is in washing my face. I know that we can’t wash one limb with water which was used for washing another limb. So the doubt is as follows: if washing the face my palms will touch hair, I start to think, that on my hands there is water which was used washing my hair, not the face, so I wash my hands, and continue washing the face with new water. The other problem is that I don’t know what part of eyes should I wash – I understand that we don’t need to wash eyes themselves, but what’s about the red area which is near roots of eyelashes (above, under, right and left to eyes)?
