Finding a Reliable Source for Haj-e-Badal: My Journey to Perform Haj for My Late Father

Q: I am looking for a good source for Haj-e-Badal. I have performed my Haj and have wish to perform Haj for my dad who is no more. I will be doing it with my money, so I believe I can do Haj-e-Tamattu also. Please correct me if I am wrong.

Bismillaah

A: When doing hajj e badal on behalf of someone, the person performing the hajj e badal should do Ifraad hajj or Qiraan hajj.

As far as Tamattu hajj is concerned, many Ulama, the likes of Hazrat Mulla Ali Qari (Rahmatullahi Alaihi), Hazrat Mufti Mahmood Gangohi (Rahmatullahi Alaihi), Hazrat Moulana Rashid Ahmad Gangohi (Rahmatullahi Alaihi), the author of Ghunyatun Naasik Hazrat Moulana Hasan Shah Muhaajir Makki (Rahmatullahi Alaihi), the author of Mu’allimul Hujjaaj Hazrat Moulana Qari Saeed Ahmad (Rahmatullahi Alaihi) have all issued the ruling that it is not permissible for the person performing hajj e badal to do Tamattu hajj and if he does Tamattu hajj, the hajj e badal will not be valid.

The reason for hajj e badal not being valid is that the one doing the Tamattu hajj will pass the miqaat with the ihraam of umrah and not the ihraam of hajj. He will only enter into the ihraam of hajj prior to the days of hajj. Whereas the one doing hajj e badal should pass the miqaat with the ihraam of hajj.

However, according to some Ulama, the likes of Hazrat Mufti Shafi Uthmaani (Rahmatullahi Alaihi), Hazrat Mufti Rashid Ahmad Ludhiyaanwi (Rahmatullahi Alaihi), the author of Lubaabul Manaasik Hazrat Shaikh Rahmatullah Sindhi (Rahmatullahi Alaihi), it is also permissible for the one doing hajj e badal to do Tamattu hajj on condition that he seeks permission from the one on whose behalf he is doing hajj e badal. In this case, the damm e shukr will be compulsory upon the one doing the hajj e badal and not upon the one on whose behalf the hajj e badal is being done. However, if the person on whose behalf the hajj e badal is being done is pleased to pay for the damm e shukr, it will be permissible.
