How will the estate be divided if the deceased spouse had a joint bank account?

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: My parents had a joint bank account. Recently my father died. Now will the whole amount or half the amount in this account belong to my mother? Or will it be distributed to all the heirs?

Bismillaah

A: Only the amount that belonged to your mother will be her personal wealth. The remainder wealth will be part of the estate and will have to be distributed among the heirs according to the laws of inheritance.

And Allah Ta’ala (الله تعالى) knows best.
