Q: A few years ago, I went for Hajj. May Allah Ta’ala forgive me, at that time (I can’t remember if it was before or after Arafaat), I committed the terrible sin of masturbation. May Allah Ta’ala forgive me. What is the penalty for this? Also, does that act break ghusl? I doubt I made a ghusl after I committed that act. May Allah Ta’ala forgive me.
A: You should sincerely repent to Allah Ta’ala for committing this sin and make a firm resolve that you will not repeat this sin in the future. Similarly, you should give damm for committing this sin in the state of ihraam. The damm is that a goat or sheep will have to be slaughtered on your behalf in the precincts of the haram as an atonement for this sin.
Yes, it breaks the ghusl.

[الفصل الرابع في الجماع في الحج والعمرة] – (الفصل الرابع في الجماع) الجماع فيما دون الفرج واللمس والقبلة بشهوة لا تفسد الحج والعمرة، أنزل أو لم ينزل، وعليه دم كذا في محيط السرخسي وكذا لو عانقها بشهوة. ولو أتى بهيمة فأولجها فلا شيء عليه إلا إذا أنزل فيجب عليه الدم ولا تفسد حجته ولا عمرته هكذا في شرح الطحاوي في باب الحج والعمرة. وإن نظر إلى فرج امرأة بشهوة فأمنى لا شيء عليه كما لو تفكر فأمنى كذا في الهداية وكذا إن أطال النظر أو كرر كذا في غاية السروجي شرح الهداية. وكذا الاحتلام لا يوجب شيئا سوى الغسل، وإن استمنى بكفه فأنزل فعليه دم عند أبي حنيفة – رحمه الله تعالى – كذا في السراج الوهاج (الفتاوى الهندية 1/244)
باب الجنايات الجناية: هنا ما تكون حرمته بسبب الإحرام أو الحرم، وقد يجب بها دمان أو دم أو صوم أو صدقة ففصلها بقوله (الواجب دم على محرم بالغ) فلا شيء على الصبي خلافا للشافعي (ولو ناسيا) أو جاهلا أو مكرها، فيجب على نائم غطى رأسه (إن طيب عضوا) كاملا ولو فمه بأكل طيب كثير أو ما يبلغ عضوا لو جمع … (أو قبل) عطف على حلق (أو لمس بشهوة أنزل أو لا) في الأصح أو استمنى بكفه أو جامع بهيمة وأنزل (الدر المختار 2/555)
(الواجب دم على محرم بالغ) … (أو قبل) عطف على حلق (أو لمس بشهوة أنزل أو لا) (أو قبل) عطف على حلق (أو لمس بشهوة أنزل أو لا).(الدر المختار 2/543-555)
وإن استمنى بكفه فأنزل فعليه دم عند أبي حنيفة – رحمه الله تعالى – كذا في السراج الوهاج.(الفتاوى الهندية 1/244)
(الفصل الثالث في المعاني الموجبة للغسل وهي ثلاثة) منها الجنابة وهي تثبت بسببين أحدهما خروج المني على وجه الدفق والشهوة من غير إيلاج باللمس أو النظر أو الاحتلام أو الاستمناء.كذا في محيط السرخسي من الرجل والمرأة في النوم واليقظة. كذا في الهداية.(الفتاوى الهندية 1/14)

Q: Is there any alternative to the dam. I have no issue in giving the dam, however in order to fulfill it, I will need to inform my parents of my sin. If there is no alternative, please advise me as to how I should inform my parents, what to tell them. Also, given that I didn’t make ghusl following the act, was my hajj valid?
A: There is no alternative for the dam. However, if presently you do not have the means to give the dam, then you may delay it till the time when you have the means. You do not have to inform your parents.
Your hajj is valid.

Q: I asked if my hajj was valid given that I didn’t make ghusl following the act. What I mean is that I’m not sure if I had, and it’s really unlikely that I had ghusl for Tawaaf uz Ziyaarah. What is the penalty for making tawaaf in a state requiring ghusl? And is the hajj still valid?
A: If you are certain that you performed tawaaf ziyaarah in the state of janaabat, then dam is compulsory. The dam is that you slaughter a camel or cow in the precinct of the haram as an atonement for the sin. Similarly, you should make tawba and ask Allah Ta’ala’s forgiveness. No dam is compulsory for making the saee after the tawaaf ziyaarah in the state of janaabat.
