Nikaah performed in the state of janaabat

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: If a woman or man bathed before their nikah and didn’t know they had to rub their scalp but every strand of hair (atleast they thought) was wet would this mean the nikah would be invalid as ghusl was not done completely? What about a woman who bathed after her periods before her nikah and missed some parts of ghusl but thought she was cleans. Is nikah invalid?

What if she did ghusl like this for 4 or 5 months after nikah and did ghusl like this after periods and sex? Does nikah invalidate? What if any part of the ghusl was done incorrectly or missed what is the effect of nikah? Is it invalidated?

Bismillaah

A: The validity of the nikaah is not subject to being paak. If the nikaah was performed in the state of janaabat, the nikaah will be valid.

As far as the ghusal is concerned, if one had completed the fard of the ghusal, the ghusal will be valid. One should not pay attention to the doubts and stray thoughts that later on come in ones mind. Nevertheless, if one is certain that one did not gargle the mouth or rinse the nose while making fardh ghusal, the ghusal will not be complete. However, later on, when one rinses one’s nose or gargles the mouth e.g. while making wudhu, the ghusal that was incomplete will now be complete. It will not be necessary for one to repeat the entire ghusal.

And Allah Ta’ala (الله تعالى) knows best.
