Asking a security guard to help without the consent of the employers

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: I stay in a complex which has a guard employed. The guard works shifts, one guard in the day and a different guard in the night. I was feeling sick and could not carry the groceries out of the car, so I asked the guard to carry the items and I would pay him R50.

1. Is this permissible because he is hired by the building so I distracted him from his work.

2. If I simply asked him for help without the condition of payment, then paid him a tip, would this be fine?

Bismillaah

A: To use him for your personal work while he is in the employ of another company is impermissible. If you need to use him you will need to obtain consent from his employers.

And Allah Ta’ala (الله تعالى) knows best.
