Should one subtract vat and taxes when calculating one’s zakaat?

Q: With regards to calculating one’s zakaat in a business setup, sometimes one’s zakaat date falls a few days before one pays his vat and taxes. Sometimes, the amount of the vat and taxes can reach an amount of one million or two million. Can one subtract this amount when calculating his zakaat, just as one subtracts his debts?

Bismillaah

A: No. One will not subtract the vat and taxes when calculating zakaat.

ولو كان الدين خراج أرض يمنع وجوب الزكاة بقدره وهذا إذا كان خراجا يؤخذ بحق وكان تمام الحول بعد إدراك الغلة وأما إذا كان قبل إدراكها فلا وما يؤخذ بغير حق لا يمنع وجوب الزكاة ما لم يؤخذ منه قبل الحول وكذلك الأرض العشرية إذا أخرجت طعاما واستهلكه وضمن مثله دينا في الذمة وذلك قبل تمام الحول على الدراهم ثم تم الحول على الدراهم فليس عليه الزكاة هكذا في التتارخانية (فتاوى هندية 1/173)
