Duration of Fasakh for Women: Dissolving Marriage

Answered as per Hanafi Fiqh by Muftionline.co.za

Q:

1. If a woman applies for fasakh, what is the duration until the marriage will be disssolved?

2. Does she have to sit in iddat?

Bismillaah

A:

1. One is the application and one is the annulment. The faskh is subject to the officer or aalim or group that is in charge in annulling the nikaah. Once they have declared the annulment then only is the nikaah annulled.

2. Yes.

And Allah Ta’ala (الله تعالى) knows best.
