Doing Hajj-e-badl for a person who did not make a bequest

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: A person passed away without fulfilling his/her hajj. Can the family pay someone living in Makkah to do the hajj on behalf of the person that passed away?

Bismillaah

A: If he has not made a bequest and he has not left any wealth for that purpose then an optional hajj can be done by anybody. However, it should be seen that this wealth is not taken out from his estate. If any individual wishes to do so he may do so from his own wealth.

And Allah Ta’ala (الله تعالى) knows best.
