Islam’s Parental Rights for Rapists: Does the Child Belong to Them?

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: What is the parental right of the rapist in islam? Does the child belong to him or not?

Bismillaah

A: The child born out of wedlock will be attributed to the mother. The biological father does not have any right whatsoever over the child. He is not regarded as the legitimate father. For further details refer to http://muftionline.co.za/node/10533
