Husband refusing to accept Islam

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: Foreigners in our town have reverted a married women (she is working for them) to Islam. Her husband refuses to become a Muslim. Is her marriage still valid? She has children and was not told this fact as she does not want her marriage to end. Please confirm.

Bismillaah

A: She should immediately move away from her husband. If her husband does not accept Islam within the iddat period (i.e three haidh), the nikaah will break. If he accepts Islam within this period, then the nikaah will not break and she can continue living with him.

And Allah Ta’ala (الله تعالى) knows best.
