Can a Father’s Will Force One Daughter to Pay Rent to Another?

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: If a man said in his will that his 1 daughter must live in his house and give the rent to his other daughter, who is a widow and the other heirs agreed to it, is it permissible?

Bismillaah

A: A bequest is not made for an heir. After his demise if the heirs make an internal arrangement within themselves then it is permissible to make this type of an arrangement provided there is no coercion.

And Allah Ta’ala (الله تعالى) knows best.
