Triple Talaaq: My Regretful Divorce Deed and the Question of Authenticity

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: I would like to ask that I gave my wife who is from India I am from the UK. I gave her three talaaq via a solicitor. The marriage was not consummated. I was in a lot of anger and confusion. My mental state was not right. My solicitor told me that if I want to divorce my wife I can do it by a divorce deed via talaaq. I did not intend to divorce my wife that way because I wanted to divorce by the uk courts. I was told by several solicitors that under uk law I could not divorce my wife in the uk until after one year of marriage. After our marriage we only spent four days together and slept in Separate beds. As I had to leave for the UK. We were not always alone. Anyways I was told to divorce by divorce deed. As I wasn’t thinking straight. I just went along with it certain things written on the divorce deed were not my entire wording. My intentions were not to divorce as three talaaqs. As I was not aware of the procedure and understanding and as I did not write or directly utter the the words to my wife I question this authenticity of the triple talaaqs. As it was a solicitor that prepared the three talaaqs I did not make much of it at that time. But I regret my actions. Is there anyway I can get my wife back please.

Bismillaah

A: All three divorces have taken place.

And Allah Ta’ala (الله تعالى) knows best.
