Having relations during iddat

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: I applied for fasgh and my husband gave me one talaaq. The second month in my iddah we had intercourse but he didn’t utter the words that he withdraws his one talaaq. Are we still married? Mufti replied we are still in nikaah and the one talaaq is valid. What does that mean? Can mufti make it clearer for me?

Bismillaah

A: A man has the right to issue three divorces. From the three divorces he has already used up one third of his right. However through having relations with you in the iddat, he has taken you back in his nikaah.

And Allah Ta’ala (الله تعالى) knows best.
