Charging the customer handling charges when cancelling the sale

Q: Is it permissible to charge the customer a handling charge when he returns an item?

Bismillaah

A: When the seller and buyer mutually agree upon cancelling the sale, the entire amount has to be refunded to the customer. It is not permissible for the seller to hold back any amount. Hence it is not permissible for the seller to charge the buyer a handling charge at the time of cancellation.

And Allah Ta’ala (الله تعالى) knows best.

باب الإقالة … ( وهي ) مندوبة للحديث وتجب في عقد مكروه وفاسد بحر وفيما إذا غره البائع يسيرا نهر بحثا فلو فاحشا له الرد كما سيجيء وحكمها أنها ( فسخ في حق المتعاقدين فيما هو من موجبات ) بفتح الجيم أي أحكام ( العقد ) أما لو وجب بشرط زائد كانت بيعا جديدا في حقهما أيضا كأن شرى بدينه المؤجل عينا ثم تقايلا لم يعد الأجل فيصير دينه حالا كأنه باعه منه ولو رده بخيار بقضاء عاد الأجل لأنه فسخ ولو كان به كفيل لم تعد الكفالة فيهما خانية ثم ذكر لكونه فسخا فروعا ( ف ) الأول أنها ( تبطل بعد ولادة المبيعة ) لتعذر الفسخ بالزيادة المنفصلة بعد القبض حقا للشرع لا قبله مطلقا ابن ملك ( و ) الثاني ( تصح بمثل الثمن الأول وبالسكوت عنه ) ويرد مثل المشروط ولو المقبوض أجود أو أردأ ولو تقايلا وقد كسدت رد الكاسد (الدر المختار 5/ 124)
