Thief dropping his personal phone after stealing one’s phone

Q: If a person who stole my phone starts running away from me after stealing my phone and whilst running his phone falls out of his pocket. What should I do with his phone?

Bismillaah

A: If his phone is equal in value to the phone he stole from you or less, then you can take it.

And Allah Ta’ala (الله تعالى) knows best.
