Can a Wife’s Testimony be Valid in a Talaq Case?

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: I am married since 2 years. My husband lives in Saudi from the past 1 year. My marital relation is very good Alhamdulillah. Before 3 months, we fought on a phone call and in very extreme anger my husband uttered 3 times “TALAQ”. Then after that he felt very sorry and told me that I don’t want to leave you. He repented a lot. After 2 days when this happened he said, I don’t remember anything that I had spoken. He is totally denying that I have not used those words. But I am 100% sure he uttered that 3 words of Talaq. Now my question is: 1. Does talaq take place in this case? Because here at my place, everyone says that only the husband’s statement is considered. If, I say that I heard 3 words completely, then as a female my statement is not valid and talaq does not take place. Please answer me with regards to this.

Bismillaah

A: Once three talaaqs are uttered by the husband, the nikaah immediately terminates. Hence, it is no longer permissible for you both to continue living together. If you both continue living together as husband and wife, you will be living in zina.

And Allah Ta’ala (الله تعالى) knows best.
