Breaking the fast of Ramadhaan through eating

Q: During the month of Ramadhaan, once I had broken my fast through eating. What is the Shar’ee ruling in such a case?

Bismillaah

A: You should sincerely repent to Allah Ta’ala for the major sin you had committed and make a firm resolve that you will never repeat this sin in the future. For the fast you had broken, you will have to keep qadha and kaffara. The kaffara for a fast that was broken in the month of Ramadhaan is that one fasts for two lunar months consecutively. If one commenced the fast on the 1st of the lunar month, then upon the completion of two lunar months (irrespective of whether the lunar months were 29 days or 30 days), the kaffarah will be discharged and if one commenced the fast from the 2nd of the lunar month or anytime thereafter, then fasting for sixty days will be compulsory.

( وإن جامع ) المكلف آدميا مشتهى ( في رمضان أداء ) لما مر ( أو جومع ) أو توارث الحشفة ( في أحد السبيلين ) أنزل أو لا ( أو أكل أو شرب غذاء ) بكسر الغين والذال المعجمتين والمد ما يتغذى به ( أو دواء) ما يتداوى به والضابط وصول ما فيه صلاح بدنه لجوفه ومنه ريق حبيبه فيكفر لوجود معنى صلاح البدن فيه دراية وغيرها وما نقله الشلانبلالي عن الحدادي رده في النهر ( عمدا ) راجع للكل ( أو احتجم ) أي فعل ما لا يظن الفطر به كفصد وكحل ولمس وجماع بهيمة بلا إنزال أو إدخال أصبع في دبر ونحو ذلك ( فظن فطره به فأكل عمدا قضى ) في الصور كلها ( وكفر ) (الدر المختار 2/ 409)

( صام شهرين ولو ثمانية وخمسين ) بالهلال وإلا فستين يوما

قال الشامي : وحاصله أنه إذا ابتدأ الصوم في أول الشهر كفاه صوم شهرين تامين أو ناقصين وكذا لو كان أحدهما تاما والأخر ناقصا قوله ( وإلا ) أي وإن لم يكن صومه في أول الشهر برؤية الهلال بأن غم أو صام في أثناء شهر فإنه يصوم ستين يوما (رد المحتار 2/ 403)
