Returning stolen money to the estate of the deceased

Q: I used to bring my grandmother’s pension. One day I took 1000 rupees without telling her from her pension. I want to pay her now but she has passed away. What should I do?

Bismillaah

A: The money will have to be returned to the estate and distributed among the heirs according to the stipulated shares of inheritance.

And Allah Ta’ala (الله تعالى) knows best.

قال الشامي : والحاصل أنه إن علم أرباب الأموال وجب رده عليهم (رد المحتار 5/ 99)

قال الشامي : وقال في النهاية قال بعض مشايخنا كسب المغنية كالمغصوب لم يحل أخذه وعلى هذا قالوا لو مات الرجل وكسبه من بيع الباذق أو الظلم أو أخذ الرشوة يتورع الورثة ولا يأخذون منه شيئا وهو أولى بهم ويردونها على أربابها إن عرفوهم وإلا تصدقوا بها لأن سبيل الكسب الخبيث التصدق إذا تعذر الرد على صاحبه اه (رد المحتار 6/ 385)
