Omitting Jumuah Salaah on account of one’s employment

Q: I am facing a difficult situation at work where my employer won’t give me off for Jumuah Salaah. I sometimes switch my shift or lunches and sometimes take off. What can I do to remedy this? It is affecting me emotionally and spirituality.

Bismillaah

A: Jumuah Salaah is among the salient features and symbols of Islam. The one who omits the Jumuah Salaah without any valid reason has committed a major sin in the sight of Allah Ta’ala. Not attending the Jumuah Salaah on account of one’s employment is not a valid excuse for omitting the Jumuah Salaah. Hence if the company does not allow you to go for Jumu’ah Salaah, then you should find another job.

And Allah Ta’ala (الله تعالى) knows best.

ذَٰلِكَ وَمَن يُعَظِّمْ شَعَائِرَ اللَّـهِ فَإِنَّهَا مِن تَقْوَى الْقُلُوبِ ﴿الحج: ٣٢﴾

يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا نُودِيَ لِلصَّلَاةِ مِن يَوْمِ الْجُمُعَةِ فَاسْعَوْا إِلَىٰ ذِكْرِ اللَّـهِ وَذَرُوا الْبَيْعَ ذَٰلِكُمْ خَيْرٌ لَّكُمْ إِن كُنتُمْ تَعْلَمُونَ ﴿الجمعة: ٩﴾ 

عن جابر بن عبد الله قال قال رسول الله صلى الله عليه و سلم من ترك الجمعة ثلاثا من غير ضرورة طبع الله على قلبه (سنن ابن ماجة #1126)

والأصح وجوبها على مكاتب ومبعض وأجير ويسقط من الأجر بحسابه ولو بعيدا وإلا لا (الدر المختار 2/ 153)

قال الشامي : قوله ( وأجير ) مفاده أنه ليس للمستأجر منه وهو أحد قولين وظاهر المتون يشهد له كما في البحر قوله ( بحسابه لو بعيدا ) فإن كان قدر ربع النهار حط عنه ربع الأجرة وليس للأجير أن يطالبه من الربع المحطوط بمقدار اشتغاله بالصلاة تاترخانية ( مطلب في شروط وجوب الجمعة ، رد المحتار 2/ 154)

( ووجب سعي إليها وترك البيع ) ولو مع السعي وفي المسجد أعظم وزرا ( بالأذان الأول ) في الأصح

قال الشامي : قوله ( وترك البيع ) أراد به كل عمل ينافي السعي وخصه اتباعا للآية نهر (رد المحتار 2/ 161)
