Estate Distribution: A Complex Family Situation

Q: A lady passed away and her family remained as follows: A mother, 6 siblings, a husband, a son from her previous marriage – her husband also had two sons from his previous marriage – however the lady and her husband did not have any of their own children. How will her estate be distributed?

Bismillaah

A: Her heirs in this case will be her mother, her son and the present husband. The estate will be divided into 12 equal shares and distributed as follows:

Mother will receive 2 shares

Husband will receive 3 shares

Son will receive 7 shares

And Allah Ta’ala (الله تعالى) knows best.
