Inheriting Property: How Will My Brother’s Estate be Divided Among Us?

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: my brother passed away who was parentless and unmarried. He left his personal property. We are two brothers and four sisters. Please tell us how his property will be distributed among us.

Bismillaah

A: If his only surviving heirs are his two brothers and four sisters then after paying burial expenses, paying of debts and fulfilling bequests upto one third of the estate then his estate will be divided into eight equal shares and distributed as follows:

Each brother will receive 2 shares

Each sister will receive 1 share

And Allah Ta’ala (الله تعالى) knows best.
