Partaking of Sadaqah

Answered as per Hanafi Fiqh by Mahmoodiyah

Question:

Assalamualaikum,

Kaisay meezaj hain aap kay? Umeed hai kay khariyat say hogaye. Basically, I have a few questions regarding Sadaqah. I want to make some food; i.e. rice and distribute it as Sadaqah amongst the poor. Currently, I am residing in England and thus due to a lack of poverty in this country, I am going to send money to my uncle in Pakistan who will hire a chef to prepare rice. What I want to know is that can my uncle and his family also eat this cooked rice, bearing in mind they are not poor? What about other relatives, such as grand father, can they be given some of this cooked rice?

Correct me if I am wrong, but I remember once reading a Hadith where a Sahabi was given a glass of milk, He asked what the milk was for, when the answer came that it was Sadaqah, the Sahabi refused to drink it as he wasn’t poor and thus feared punishment on the Day of Qiyaamah for eating what was intended for the poor. The Sahabi may even have drank the milk and later realising it was Sadaqah, made himself sick so that the unlawful drink left his body. Could you please clarify this Hadith and quote the exact wording in full when sending your reply.

On the other hand, should I change my intention and distribute the rice with the intention of fee Sabeelillah. Will this then allow my uncle to eat some of the cooked rice and other family members such as Grand father etc? Also, will I get less Thawaab (reward) if I change my intention from Sadaqah to fee Sabeelillah?

Your co-operation in to the above query will be greatly appreciated and I look forward to hearing from you very soon.

Wa salaam,

Answer:

Sadaqah Waajibah, i.e. Zakaat, Fitrah and Nazar (oaths) is only for the poor.  The rich cannot consume of it.  The ruling of Sadaqah Naafilah, on the other hand, is different.  The affluent amongst you can also consume of it.  Therefore it your intention is that of Sadaqah Naafilah then your affluent relatives, i.e. uncle, grandfather, etc can consume of the Sadaqah Naafilah.  This will be a Hibah (gift) to them from you and you will attain the reward of giving them a gift and also attain the reward of Silatur Rahim (joining of family ties).  If the poor consume of this Sadaqah Naafilah then you will attain the reward of Sadaqah therefore you should feed both your relatives and the poor people from this meal too.  This will be known as Fee Sabeelillah.

I have no knowledge of the incident that you have mentioned.

And Allah Ta’ala knows best
