Masaail on Salaah

Answered as per Hanafi Fiqh by Mahmoodiyah

Question:

1.  It has been mentioned in Hadith in the near meaning that when praying Salaat if a person walks in front of you then you should stop him and if he does not stop you should fight with him.  Could you please provide the Hadith with reference?

2.  I read in the book ‘The Way of Sahabah’ by Moulana Nadvi that a person went pass Abu Said Khudri (R.A.) Sahabi who was praying Salaat.  The Sahabi tried to stop the person going pass but the person did not stop so the Sahabi beat him and mentioned the Hadith in question.  So my question is that is it permissible to beat someone who passes in front of you praying Salaat?

3.  Is it the order of Prophet (S.A.W.) to beat a person who walks in front of a person praying Salaat?

Answer:

1.        Reference to the mentioned Hadith is in the following Kitaabs:  Mishkaat, Page 74, Bukhari, Vol. 1, Page 196-197.

2.        It is not permissible to beat someone who passes in front of the Musalli.  According to the Ahnaaf the ruling of Dafa’ is a mere concession which can also be done by means of signs.  Nevertheless, abstaining from this is better.  According to Imam Sarakhsi the ruling mentioned in the Hadith:  “Fal yadfa’hu fa innamaa huwa shaytaanun” is abrogated since this was only applicable in the initial years of Islam when ‘Amal was permitted in Salaah.  (Ad-Durrul Mukhtaar, Vol. 1, Page 471)

3.        This is an abrogated order of the Holy Prophet (S.A.W.).  (Ad-Durrul Mukhtaar, Vol. 1, Page 471)
