Regarding the Muqtadis Salaah being Makrooh due to the Imam’s Salaah being Makrooh, Hazrat Moulana Ashraf Ali Thanwi (R.A.A.) has stated that no explicit text is found with regards to this but it is understood from the fundamentals that if the Imam’s Salaah is rendered Makrooh due to a deficiency caused within the form of the Salaah (i.e. actions that form the Salaah) e.g. omitting a Waajib or adding something extra to the Salaah then the Muqtadis Salaah will also be rendered Makrooh because in this case the Salaah itself is Makrooh and one of the fundamentals is that the Imam’s Salaah includes the Muqtadis Salaah.  On the contrary, if the Imam’s Salaah was rendered Makrooh due to a deficiency that was not within the form of the Salaah e.g.  Performing Salaah (correctly) in such a condition that is against the Shari’ah then this will not render the Muqtadis Salaah Makrooh because in this case the Salaah itself is not Makrooh.  However, it will be Makrooh to appoint such an Imam.  (Imdaadul Fataawaa, Vol. 1, Page 263)

Mufti Azizur Rahman sahib (R.A.A.) has stated that the Imam who keeps his garment below his ankles is a Faasiq (open transgressor).  He should not be appointed as an Imam but it will be better to perform Salaah behind such an Imam if it is not possible to remove him and the Muqtadi will be rewarded for performing Salaah with Jamaat.  (Fataawaa Darul Uloom Deoband Mudallal Mukammal, Vol. 3, Page 117)

Mufti Rashid Ahmed sahib (R.A.A.) has stated that it is not Waajib to repeat the Salaah that was performed behind a Faasiq because it is not mentioned in any Hadith or statements of the Fuqahaa.  (Ahsanul Fataawaa, Vol. 3, Page 263).  Mufti Rashid Ahmed sahib (R.A.A.) has also stated in Ahsanul Fataawaa, Vol. 3, Page 275 that the Muqtadis Salaah will be rendered Makrooh due to the Imam’s Salaah being Makrooh but he did not mention the details of this statement nor did he pass a verdict on repeating the Salaah.  It is possible that the research of Moulana Ashraf Ali Thanwi (R.A.A.) mentioned above is applicable here too. 

In Ahsanul Fataawaa, Vol. 3, Page 296 Mufti sahib has also stated that it is not permissible to appoint such an Imam who lets his garment hang over the ankles.  On another occasion he states that the one who shaves his beard is a Faasiq and it is Makrooh to appoint him as an Imam.  However, if he leads the Salaah it will be better to perform Salaah behind him than individually… it is not permissible to willingly appoint a Faasiq as an Imam.  If the Masjid committee appoints a Faasiq Imam and no good Imam is available (in another Masjid) then one should not miss Jamaat, rather one should perform Salaah behind the Faasiq Imam.  The Masjid committee will be responsible for his appointment as an Imam.  (Ahsanul Fataawaa, Vol. 3, Page 262)

It is understood from the abovementioned verdicts of the Akaabireen that the one who leaves his garment to hang below his ankles is a Faasiq and his own Salaah will be Makrooh but according to the research of Hazrat Moulana Ashraf Ali Thanwi (R.A.A.), his Salaah being Makrooh will not render the Muqtadis Salaah Makrooh because the Muqtadi himself is not indulging in any Makrooh act and in light of Mufti Rashid Ahmed sahib (R.A.A.)’s Fatwaa it is not Waajib to repeat the Salaah read behind the Faasiq. 

Therefore the verdict in Question 1 of Fatwaa no. 141/04 is restricted to that particular situation which was passed in light of Hazrat Moulana Ashraf Ali Thanwi (R.A.A.)’s research.  We apologise for not mentioning the restriction as the question was pertaining to that particular situation.
