Zakat on loan with no hope of recovery

I understand Zakat is necessary on money loaned to others. However, if a person loses hope or has very little hope of recovering the money, is Zakat still due?

Answer

If a creditor loses hope of recovery or has very little hope, Zakat is not necessary on the loaned amount. If at any point in the future, he recovers the money, Zakat will be due from this date onwards (on his next Zakat anniversary, or the passing of one lunar year if he has no other Zakatable assets) and does not have to be backdated.

قال محمد في الأصل (٢/١٢٠): قلت: أرأيت الرجل يكون له على الرجل دين فيكافره فيمكث سنة يكافره به وليست له عليه بينة ثم يقضيه إياه بعد ذلك هل عليه زكاة ما مضى؟ قال: لا. قلت: ولم؟ قال: لأنه قد كان يجحده، وليس هذا بمنزلة الدين الذي يقر له به. وقال (٢/٢١٦): قلت: أرأيت رجلا أودع رجلا مالا فجحده سنين ثم رده عليه هل عليه زكاة ما مضى؟ قال: ليس عليه زكاة فيما مضى، انتهى۔

هذا إذا جحده. أما إذا أقر به فقال ابن عابدين في رد المحتار (٢/٢٦٦): وفي المحيط عن المنتقى عن محمد: لو كان له دين على وال وهو مقر به إلا أنه لا يعطيه وقد طالبه بباب الخليفة فلم يعطه فلا زكاة فيه. وقال (٢/٣٠٦) في مسألة الدين الضعيف: والحاصل أنه إذا قبض منه شيئا وعنده نصاب يضم المقبوض إلى النصاب ويزكيه بحوله، ولا يشترط له حول بعد القبض، ثم اعلم أن التقييد بالضعيف عزاه في البحر إلى الولوالجية والظاهر أنه اتفاقي، انتهى. وقال الشيخ أشرف علي التهانوي في إمداد الفتاوى (٢/٦٣): قول  مختار یہ ہے کہ جس قرض کے وصول ہونے کی امید ضعیف ہو یا بالکل نہ ہو ، قبل وصول اس پر زکوۃ واجب نہ ہوگی، اور وصول کے بعد جس قدر وصول ہوگا بعد حولان حول آئندہ صرف اسی قدر پر زکوۃ واجب ہوگی ، انتهى. ونحوه في جديد فقهي مباحث (٧/٩٥٠)۔
