Travel distance: 48 miles or 54.5 miles

Can I please have some clarity with reference to several of your Fatwas, where there are two distances recorded in miles for the distance of travel: 48/54.5 miles.

According to the ḥanafī school of thought, the distance of three days and nights travel constitutes travel for the purpose of shortening Ṣalāh and the prohibition of women’s travel without a maḥram or husband. This is based on the distance a person normally travels in this period by riding a camel and walking. Jurists have later specified this in miles and there are several views in relation to this including but not restricted to: 15 farsakh (45 sharʾī miles), 16 farsakh (48 sharʾī miles), 18 farsakh (54 sharʾī miles) and 21 farsakh (63 sharʾī miles). There is also a difference of opinion in relation to what constitutes a sharʾī mile, also known as the hāshmī mile. The most famous view is that one sharʾī miles is equivalent to 1.1363636 English miles. Accordingly, 16 farsakh or 48 sharʾī miles equals 54.5 English miles (rounded off), as mentioned by Mufti Rashīd Aḥmad Ludyānwī (d. 1422/2002). On the other hand, many of our scholars from the sub-continent such as Mawlānā Ashraf ʿAlī Thānawī (d. 1362/1943), Mufti Muḥammad Shafīʿ ʿUthmānī (d. 1396/1976) and Mawlānā Ẓafar Aḥmad ʿUthmānī (d. 1394/1974) suggest that the distance of travel is 48 English miles.

Accordingly, we have mentioned both views as both are famous, although 54.5 miles appears to be preferred and more cautious in relation to qaṣr. The important aspect is a person should be consistent in his use of either position. For further reading, refer to Beheshtī Zewar (p.118), Jawāhir al-Fiqh (3:425), Fatāwā Shaykh al-Islām Mawlānā Ḥusayn Aḥmad (p.48) and Aḥsan al-Fatāwā (4:91).

قال في الأصل (١/٢٦٥): قلت: أرأيت المسافر هل يقصر الصلاة في أقل من ثلاثة أيام؟ قال: لا. قلت: فإن سافر مسيرة ثلاثة أيام فصاعدا؟ قال: يقصر الصلاة حين يخرج من مصره، انتهى. وقال البخاري في الصحيح (١٠٨٦): وكان ابن عمر وابن عباس رضي الله عنهم يقصران ويفطران في أربعة برد وهي ستة عشر فرسخا، انتهى۔

وفي الموطأ (٤٩٠) رواية يحيى بن يحيى: مالك عن ابن شهاب عن سالم بن عبد الله عن أبيه أنه ركب إلى ريم، فقصر الصلاة في مسيره ذلك. قال يحيى قال مالك: وذلك نحو من أربعة برد. مالك عن نافع عن سالم بن عبد الله أن عبد الله بن عمر ركب إلى ذات النصب، فقصر الصلاة في مسيره ذلك. قال يحيى قال مالك: وبين ذات النصب والمدينة أربعة برد. مالك أنه بلغه أن عبد الله بن عباس كان يقصر الصلاة في مثل ما بين مكة والطائف، وفي مثل ما بين مكة وعسفان، وفي مثل ما بين مكة وجدة. قال يحيى قال مالك: وذلك أربعة برد. وقال يحيى قال مالك: وذلك أحب ما تقصر الصلاة فيه إلي، انتهى۔

وما قاله صحيح، لأن المسافة بين مكة والجدة اليوم ٥٥ ميلا انكليزيا تقريبا، وهي ٤٨ ميلا شرعيا. ونحوه الطائف۔

قال مقيده عفا الله عنه: الظاهر من كلام محمد بن الحسن الشيباني في الحجة (١/١٦٦) أن مسافة ثلاثة أيام ولياليها هي أكثر من أربعة برد أي ٤٨ ميلا هاشميا، لأنه قال: فلأن يتم الرجل فيما لا يجب عليه أحب إلينا من أن يقصر فيما يجب فيه التمام، انتهى. فظهر أنها لا تكون أقل من ٤٨ ميلا هاشميا، بل ولا مساويا، ولذلك المرجح عند الحنفية هو ١٨ فرسخا أي ٥٤ ميلا شرعيا وهو ٦١.٣٦ ميلا إنكليزيا كما في أحسن الفتاوى، فاحفظ۔

فائدة: قال شيخنا محمد يونس الجونفوري في نبراس الساري في رياض البخاري (٣/٥٨٠): هذا الميل ينسب إلى جد النبي صلى الله عليه وسلم هاشم، وكان شهيرا في العالم، وهو إلى الآن باق في لندن، ولكن أراد اليهود أن يهدموا شريعة النبي صلى الله عليه وسلم، فاختاروا لذلك حيلا، هم الذين أوجدوا الشيعية، وهم الذين غيروا المسائل الجزئية، فأوجدوا الكيلومتر لينهدم ما عليه المسافر من أخذ العبادة وطريقها في السفر، انتهى۔
