Nikah in the Masjid and women attending Nikah

Some people insist that Nikāḥ must be performed in the Masjid and give the impression that those who perform Nikāḥ elsewhere are doing something wrong. Others suggest that there is no evidence to signify performing Nikāḥ in the Masjid and that the ḥadīth in this regard is weak. What is the preferred view?

Also, are women allowed to be present at the Nikāḥ (separate from the men), whether at the Masjid or elsewhere?

Answer

(1) Nikāḥ in the Masjid is mustaḥab (desirable) according to the Ḥanafī, Shāfiʿī and Ḥanbalī schools of thought. It is true that the specific ḥadīth in this regard is weak. However, there is an authentic ḥadīth which mentions, “Announce the Nikāḥ”. Accordingly, most scholars suggest that the Masjid is preferred as it is a blessed place and it enables maximum publicity of Nikāḥ, which is unanimously recommended. Nowadays, it is all the more important that marriages are undertaken in the Masjids. This is because an increasing trend is being noticed of marriages taking place in wedding venues where the rules of Shariah are violated with intermingling with the opposite gender, music and many other reprehensible sins. In light of this increasing trend, it is strongly recommended that marriages are undertaken in the Masjids and the rules of Shariah are complied with throughout the marriage process.

Nevertheless, if a person decides to perform the Nikāḥ outside the Masjid, this is permissible as long as the rules of Shariah are not violated. The marriage will be valid and no sin will be incurred. There are examples from the Prophetic era of companions whose marriages were conducted outside the Masjid.

(2) It is permissible for women to be present at the Nikāḥ if there are appropriate segregated facilities.

عن عبد الله بن الزبیر أن النبي صلی الله علیه وسلم قال: أعلنوا النكاح ، رواه ابن وهب في الجامع (۲٤٥) ومن طریقه أحمد (۱٦۱۳۰) والطبراني في الأوسط (٥۱٤٥) والبیهقي (۱٤٦۸٦) وصححه ابن حبان (٤۰٦٦) والحاكم (۲۷٤۸) ووافقه الذهبي. قال الطبراني: تفرد به ابن وهب ، انتهی. وقال البیهقي: تفرد به عبد الله بن الأسود عن عامر ، انتهی. ونقل الحافظ في الفتح (٩/۲۲٦) تصحیح ابن حبان والحاكم وسكت علیه. وقال الهیثمي (٤/۲۸۹): رجال أحمد ثقات، انتهی۔

وكتبت في بعض أجوبتي: استحب الجمهور النكاح في المسجد.  فمن الحنابلة صرح باستحبابه ابن تیمیة في فتاویه (٣٢/۱۸) وابن القیم في إعلام الموقعین (٣/۱۰۲) والبهوتي في كشاف القناع (٢/۳٦۸)، ومن المالكیة الخرشي في شرح مختصر خلیل (٧/۷۱)، ومن الشافعیة ابن حجر المكي في تحفة المحتاج (٧/۲۱٦) والخطیب الشربیني في مغني المحتاج (٤/۲۰۷) والرملي في نهایة المحتاج (٦/۱۸٥) والشرواني في حاشیة تحفة المحتاج (٧/۱۸۹)، ومن الحنفیة ابن الهمام في فتح القدیر (٣/۱۸۹) وابن نجیم في البحر الرائق (٣/۸٦) والأشباه والنظائر (٤/٥۸) وسراج الدین بن نجیم في النهر الفائق (٢/۱۷٦) والشلبي في حاشیة تبیین الحقائق (٢/۹٥) وعلي القاري في المرقاة (٥/۲۰۷۲) وعبد الرحمن شیخي زاده في مجمع الأنهر (١/۳۱۷) والحصكفي في الدر المختار (٣/۸) وابن عابدین في رد المحتار (١/٦٦۲ و ٣/۸). أما جمهور المالكیة فلم یستحبوا النكاح في المساجد بل جوزوه، كما جزم به الحطاب في مواهب الجلیل (٣/٤۰۸)، وهو ظاهر كلام ابن العربي في عارضة الأحوذي (٤/۳۱۱) وخلیل في مختصره والدردیر في الشرح الكبیر (٤/۷۰)، غیر أن الدسوقي قال: قد استحبه بعضهم للبركة ولأجل شهرة النكاح، انتهی۔

وعن أنس بن مالك قال: أبصر النبي صلى الله عليه وسلم نساء وصبيانا مقبلين من عرس فقام ممتنا فقال: اللهم أنتم من أحب الناس إلي، رواه البخاري (٥١٨٠)۔
