MRI Scan with burial delay or post-mortem

Is it better to have an MRI scan on the deceased or post-mortem? The MRI scan will result in the burial a day later compared to the post-mortem.

Answer

If it is necessary to have a post-mortem or MRI scan, then MRI scan is preferred. The delay of one day is less severe than post-mortem and therefore the less severe option should be chosen.

قال الله تعالى: ولقد كرمنا بني آدم. وقال النبي صلى الله عليه وسلم: كسر عظم الميت ككسره حيا. رواه أبوداود (٣٢٠٧) وابن ماجه (١٦١٦) من حديث عائشة وصححه ابن حبان (٣١٦٧). قال عبد الرزاق (٣/٤٤٤): قال سفيان: يرون أن ذلك إثما. وروي موقوفا. قال الشافعي في الأم (١/٣١٦) وحكاه البيهقي (٤/٩٦): تعني في المأثم، انتهى. ورواه ابن ماجه (١٦١٧) بسند ضعيف من حديث أم سلمة مرفوعا، ولفظه: كسر عظم الميت ككسر عظم الحي في الإثم. وقال المرغيناني في الهداية (٣/٤٦): الآدمي مكرم لا مبتذل فلا يجوز أن يكون شيء من أجزائه مهانا ومبتذلا، انتهى. وقال الزيلعي في تبيين الحقائق (٤/٥١) وتبعه ابن نجيم في البحر الرائق (٦/٨٨): الآدمي مكرم فلا يجوز أن يكون جزؤه مهانا، انتهى۔

وقال ابن نجيم في الأشباه والنظائر (ص ٧٦): إذا تعارض مفسدتان روعي أعظمهما ضررا بارتكاب أخفهما. وقال (ص ٧٥): لو كان أحدهما أعظم ضررا من الآخر، فإن الأشد يزال بالأخف، انتهى۔
