Malawi Marriage Query

In Malawi, the indigenous local Muslims have a traditional marriage, which begins with a man and a woman who decide to marry each other and they inform their families. Once the families agree, they appoint one witness from each side. The witness will lead and formally propose to the girl’s family, a date will be agreed and the two families will unite the bride and groom in a traditional marriage. According to the culture, they are now married. At this stage, no Nikāḥ sermon takes place in the Masjid or elsewhere. Sometimes, they will decide to undertake the Nikāḥ sermon at a Masjid later in life. Is this cultural marriage valid according to our Sharīʿah? Please note the indigenous local Muslims are followers of the Shāfiʿī school of thought.

Answer

There are few points worth noting:

First, the validity of Nikāḥ is subject to the following conditions:

  • Offer of marriage and acceptance from the male and female or their wakīl (representative) by using express terms of marriage or Nikāḥ.
  • The presence of two free Muslim male witnesses during the offer and acceptance, who are not blind or deaf.
  • The walī (guardian) of the girl must grant permission and consent for her marriage.

Accordingly, if the traditional marriage fulfils these conditions, the Nikāḥ will be valid from an Islamic perspective.

Second, to conduct the Nikāḥ in the Masjid or to read the Nikāḥ sermon is not a prerequisite for the validity of the marriage. Nevertheless, both these aspects are from the Sunnah. It is therefore strongly advisable for the Nikāḥ to take place in the Masjid or at least for the Nikāḥ sermon to be incorporated into the traditional marriage.

Third, once the Nikāḥ has taken place i.e. the three conditions mentioned above are fulfilled, there is no need to perform a Nikāh sermon in the Masjid later in the life, irrespective of whether the Nikāḥ sermon was included in the marriage ceremony or not.

Fourth, it is Sunnah to mention the dowry as part of the offer and acceptance, though this is not necessary.

Please note this answer has been given according to the Shāfiʿī school of thought. If a Ḥanafī follows this, his Nikāḥ will also be valid.

قال الإمام الشافعي في الأم (٧/١٦٥): ولا يجوز النكاح إلا بولي وشاهدي عدل ورضا المنكوحة والناكح، انتهى. وقال النووي في منهاج الطالبين (صـ ٢٠٥): إنما يصح النكاح بإيجاب وهو زوجتك أو أنكحتك وقبول بأن يقول الزوج تزوجت أو نكحت أو قبلت نكاحها أو تزويجها. ويصح تقديم لفظ الزوج على الولي. ولا يصح إلا بلفظ التزويج أو الإنكاح. ويصح بالعجمية في الأصح. وقال (صـ ٢٠٦): ولا يصح إلا بحضرة شاهدين، وشرطهما حرية وذكورة وعدالة وسمع وبصر، وفي الأعمى وجه. والأصح انعقاده بابني الزوجين وعدويهما. وينعقد بمستوري العدالة على الصحيح لا مستور الإسلام والحرية. وقال: لا تزوج امرأة نفسها بإذن ولا غيرها بوكالة ولا تقبل نكاحا لأحد والوطء في نكاح بلا ولي. وقال: وأحق الأولياء أب ثم جد ثم أبوه ثم أخ لأبوين أو لأب ثم ابنه وإن سفل ثم عم ثم سائر العصبة كالإرث. وقال (صـ ٢٠٧): وليقل وكيل الولي زوجتك بنت فلان وليقل الولي لوكيل الزوج زوجت بنتي فلانا فيقول وكيله قبلت نكاحها له. وقال الرملي في نهاية المحتاج (٦/٢٠٩): أركان النكاح وتوابعها هي خمسة: زوجان، وولي، وشاهدان، وصيغة، انتهى۔

وقال النووي (صـ ٢١٨) في كتاب الصداق: يسن تسميته في العقد ويجوز إخلاؤه منه. قال الرملي (٦/٣٣٥) تبعا للخطيب الشربيني في مغني المحتاج (٤/٣٦٧): أي من تسميته إجماعا لكن مع الكراهة كما صرح به الماوردي والمتولي وغيرهما، انتهى۔

وقال النووي في منهاج الطالبين (صـ ٢٠٥): ويستحب تقديم خطبة قبل الخطبة وقبل العقد، انتهى. قال الخطيب الشربيني في مغني المحتاج (٤/٢٢٤) وتبعه الشرواني في حاشية تحفة المحتاج (٧/٢١٤): (و) يستحب تقديم خطبة أخرى (قبل العقد) وهي آكد من الأولى. وتبرك الأئمة رضي الله تعالى عنهم بما روي عن ابن مسعود رضي الله تعالى عنه موقوفا ومرفوعا قال: إذا أراد أحدكم أن يخطب لحاجة من نكاح أو غيره فليقل: إن الحمد لله نحمده ونستعينه ونستغفره ونعوذ بالله من شرور أنفسنا وسيئات أعمالنا، من يهده الله فلا مضل له، ومن يضلل فلا هادي له، وأشهد أن لا إله إلا الله وحده لا شريك له وأن محمدا عبده ورسوله، صلى الله عليه وسلم وعلى آله وصحبه. يا أيها الذين آمنوا اتقوا الله حق تقاته ولا تموتن إلا وأنتم مسلمون. يا أيها الناس اتقوا ربكم الذي خلقكم، إلى قوله: رقيبا. يا أيها الذين آمنوا اتقوا الله وقولوا قولا سديدا، إلى قوله: عظيما. وتسمى هذه الخطبة خطبة الحاجة. انتهى. وحديث خطبة الحاجة رواه أبوداود (٢١١٨) والنسائي (١٤٠٤) وابن ماجه (١٨٩٢) وغيرهم۔

وقال الخطيب الشربيني في مغني المحتاج (٤/٢٠٧): ويسن أن يعقد في المسجد. ونحوه في تحفة المحتاج (٧/٢١٦) ونهاية المحتاج (٦/١٨٥)۔
