Fidyah for missed fasts and Salah

If a person passed away and had many missed fasts and Ṣalāh, how will the Fidyah be calculated? If there are a lot of missed fasts and Ṣalāh, is it possible to donate it according to the price of a cheap country like India?

Answer

Fidyah is the same as Ṣadaqat al-Fiṭr, ½ Ṣāʿ (2.94 litres) of wheat. This amount or its value has to be given for each missed Ṣalāh and Ṣawm (fast). The value is determined by the price of wheat in the location of the donor, as outlined in our detailed answer on Ṣadaqat al-Fiṭr.

If, however, a person has lots of missed Ṣalāh and Ṣawm, it is possible to make arrangements in India or elsewhere for the actual amount of wheat or wheat flour to be given to the poor. This would be cheaper and fulfil the obligation. It must be ensured that the required amount of wheat or wheat flour is given to the poor.

قال السرخسي في المبسوط (٣/٩٠): وعلى هذا إذا مات وعليه صلوات يطعم عنه لكل صلاة نصف صاع من حنطة. وكان محمد بن مقاتل يقول أولا: يطعم عنه لصلوات كل يوم نصف صاع على قياس الصوم، ثم رجع فقال: كل صلاة فرض على حدة بمنزلة صوم يوم، وهو الصحيح، انتهى. وقال المرغيناني في الهداية (٢/٣٥٩، فتح القدير): والصلاة كالصوم باستحسان المشايخ، وكل صلاة تعتبر بصوم يوم، هو الصحيح، انتهى. وقال الحصكفي في الدر المختار (٢/٧٢): (ولو مات وعليه صلوات فائتة وأوصى بالكفارة يعطى لكل صلاة نصف صاع من بر) كالفطرة (وكذا حكم الوتر) والصوم، وإنما يعطي (من ثلث ماله) ولو لم يترك مالا يستقرض وارثه نصف صاع مثلا ويدفعه لفقير ثم يدفعه الفقير للوارث ثم وثم حتى يتم (ولو قضاها ورثته بأمره لم يجز) لأنها عبادة بدنية (بخلاف الحج) لأنه يقبل النيابة، انتهى. وراجع البحر (٢/٩٨) والهندية (١/١٢٥)۔

 وقال السرخسي في المبسوط (٢/١٥٦): إن أداء القيمة مكان المنصوص عليه في الزكاة والصدقات والعشور والكفارات جائز عندنا، انتهى. ورجح البخاري وأحمد بن محمد بن الصديق الغماري ويوسف القرضاوي مذهب الحنفية كما ذكرته في جوابي في دفع القيم في الزكاة۔
