Fast of 15 Shaban in the hanafi school

(1) I understand that fasting in the month of Shaʿbān is sunnah, however, my question is specifically in relation to the fast of 15 Shaʿbān, does it hold any additional significance in the ḥanafī school of thought? I am aware that the ḥadīth in Sunan Ibn Mājah in this regard is extremely weak and cannot be used as evidence. However, as a ḥanafī, I am interested in the view of the earlier ḥanafī scholars on the matter.

(2) In addition, is it true that Mawlānā Muḥammad Yūnus Jownpūrī changed his stance on the matter and endorsed the fast before his demise?

Answer

(1) Fast of 15 Shaʿbān in the ḥanafī school of thought

Fasting in the month of Shaʿbān is sunnah. Apart from the month of Ramaḍān, the Prophet ﷺ would fast the most in this month. The virtue of fasting on 15 Shaʿbān is no different to other days of the month. The ḥadīth which specifically makes reference to the fast of 15 Shaʿbān is extremely weak and cannot be used as evidence. The desirability of fasting in this month is the position of the ḥanafī school of thought.

In so far as your specific question is concerned, we have not come across any specific reference to the fast of 15 Shaʿbān in any of the primary sources of the ḥanafī school of thought. There is no reference to it in the published books of Imam Muḥammad ibn al-Ḥasan (d. 189/805), whose books are the foundation of the school. There is also no mention of this, as far as we are aware, in the mutūn (primary texts) or their commentaries, nor in the authoritative Fatāwā collections.

In fact, Qāḍī Ẓahīr al-Dīn al-Bukhārī (d. 619/1221-2) has mentioned a list of the recommended fasts in al-Fatāwā al-Ẓahīriyyah. He mentions the fast of Shaʿbān generally and makes no reference to the fast of 15 Shaʿbān. A summary of what he has mentioned is also cited in the famous al-Fatāwā al-Hindiyyah. Al-Fatāwā al-Ẓahīriyyah is an authoritative text among our jurists.

Similarly, the famous ḥanafī jurist ʿAllāmah Sarakhsī (d.ca. 490/1097) also makes reference to the fast of Shaʿbān generally. He explains that qaḍāʾ fasts of Ramaḍān are permissible during the first nine days of Dhū al-Ḥijjah, similar to other recommended days of fasting such as ʿĀshūrāʾ (10 Muḥarram) and the fast of Shaʿbān. Fasting in the month of Muḥarram is generally recommended similar to Shaʿbān, however, he makes a specific reference to ʿĀshūrāʾ due to its additional virtues but does not make a specific reference to the fast of 15 Shaʿbān. Similarly, the famous ḥanafī scholar Shaykh ʿAbd al-Ḥaq Muḥaddith Dehlawī (d. 1052/1642) has mentioned the fast of Shaʿbān from the recommended fasts and has not made any specific reference to the fast of 15 Shaʿbān.

It is for this reason, our respected teacher Muḥaddith al-ʿAṣr Mawlānā Muḥammad Yūnus Jownpūrī (d. 1438/2017) was firmly of the view that the specific fast of 15 Shaʿbān is not mustaḥab, neither from a fiqh perspective nor from a ḥadīth perspective. He has a detailed treatise on this issue, the summary is outlined below in answer to your second question. The view of Mufti Rashīd Aḥmad Ludyānwī (d. 1422/2002), Shaykh al-Islām Mufti Muḥammad Taqī ʿUsmānī (b. 1362/1943), Shaykh al-Hadith Mufti Shabbīr Aḥmad (b. 1376/1957) and Mawlānā Faḍl al-Raḥmān al-Aʿẓamī (b. 1356/1946) is also similar to Shaykh’s view.

Mufti Rashīd Aḥmad Ludyānwī writes, “The fast of this day is not established through any reliable narration. It is neither mentioned in any book of jurisprudence. Therefore, to regard it as sunnah or mustaḥab is impermissible.”

Shaykh al-Islām Mufti Muḥammad Taqī ʿUsmānī said, “One final point in relation to 15 Shaʿbān I would like to mention is regarding the fast of 15 Shaʿbān. There is one narration that mentions the virtue of the fast of 15 Shaʿbān. However, it is an extremely weak narration and the scholars of ḥadīth and jurisprudence have not acted upon it. Thus, when the jurists mention the details of the optional fasts, there is no mention of the fast of 15 Shaʿbān in the books of jurisprudence. Therefore, the correct view is that there is virtue of fasting on each day of Shaʿbān from 1st of Shaʿbān until the end of the month except the final two days. Apart from these two days, there is virtue of fasting on any day. Accordingly, there is virtue for this day 15 Shaʿbān as well. Also, in particular, the Prophet ﷺ would frequently fast during Ayyām Bīḍ: 13, 14 and 15 of each month. Therefore, if someone fasts on 15 Shaʿbān because of this, this is fine. However, there is no virtue to fast on 15 Shaʿbān because of it being 15 Shaʿbān.” He also said, “There is no sound narration regarding the specific fast of 15 Shaʿbān.” He also said, “It is not appropriate to fast specifically on 15 Shaʿbān if the intention is that it holds additional virtue.”

Shaykh al-Hadith Mufti Shabbīr Aḥmad said, “Singling out the fast of 15 of Shaʿban is not established from the Aḥādīth. In the time of the Prophet ﷺ, the month of Shaʿbān came every year. We do not find in the books of ḥadīth that the companions regarded fasting on this day as holding some special significance or virtue. We do not find that they fasted on this day specifically in the way that they fasted on other days of the year wherein fasting is sunnah. If fasting on this day held some special significance and virtue, this would have been affirmed via authentic narrations. Similarly, we do not find this practice of fasting specifically on 15 Shaʿbān in the time of the tābiʿūn or the tabaʿ tābiʿīn. The scholars of jurisprudence from the time of the Salaf have not mentioned this fast. It was only in a later era that fasting on this day was emphasised and this did not occur except in certain parts of the Muslim world. Since then, the practice has continued in these areas. It is worth noting that fasting generally in the month of Shaʿbān is highly recommended and is a sunnah. The Prophet ﷺ would regularly fast in this month. Accordingly, one may fast on 15 Shaʿbān but should not regard it as more virtuous than fasting on other days in the blessed month.”

Shaykh al-Ḥadīth Mawlānā Faḍl al-Raḥmān writes, “Fasting on the 15th of Shaʿbān is not established from ḥadīth. Some people are of the misconception that fasting on the 15th of Shaʿbān is sunnah. They have been deceived by the ḥadīth of Ḥaḍrat ʿAlī (may Allah be pleased with him) that appears in Ibn Mājah. This narration is totally unreliable.”

In addition to this, the Shāfiʿī scholar ʿAllāmah Munāwī (d. 1031/1622) writes: “Majd ibn Taymiyyah said: There are sound narrations for the virtues of the fast of Shaʿbān. As regards the sole fast of mid Shaʿbān, there is no basis for this. In fact, it is detestable. He further said: Similarly, it is detestable to make it a festival in which food and sweets are cooked and adornments are made visible. This is from the innovated invented festivals that have no basis”. Our respected teacher Mawlānā Muḥammad Yūnus Jownpūrī cites this and comments that ʿAllāmah Munāwī has remained silent after citing this passage. It can therefore be deduced that he is in agreement with ʿAllāmah Majd al-Dīn ibn Taymiyyah.

Likewise, Shaykh al-Islām Ibn Taymiyyah has made similar comments and affirmed that the sole fast is baseless and detestable. Similarly, the famous Shāfiʿī scholar ʿAllāmah Ibn Ḥajar al-Makkī (d. 974/1567) explains that the fast of 15 Shaʿbān specifically is not sunnah, it is sunnah only if kept as part of the Ayyām Bīḍ. This is because Ayyām Bīḍ fasts are sunnah, however, it is important to note that the Ayyām Bīḍ fasts are sunnah in all months not just in Shaʿbān.

In conclusion, the fast of 15 Shaʿbān has no additional or specific significance in the ḥanafī school of thought, neither does it have any acceptable basis from a ḥadīth perspective. The ḥanafī school emphasises on fasting in the month of Shaʿbān generally in accordance with the sunnah and the position of the majority of scholars.

For completion purposes, several points are worth noting:

First, some of our scholars from the sub-continent of the recent past have mentioned that the sole fast of 15 Shaʿbān is mustaḥab or sunnah. They are preceded by a small group of mālikī and shāfiʿī scholars. They relied on the ḥadīth of Sunan Ibn Mājah in good faith thinking that it is authentic or of the category of weak which is acceptable in matters of virtue. They will be rewarded for their ijtihad in this regard. However, now that the status of the narration has become clear, there is no need to insist on this view. It is for this reason, the aforementioned senior scholars who are from or linked to the sub-continent have clarified the matter and this is a testimony to their objectivity, balance and fairness.

Second, if someone wishes to fast on 15 Shaʿban, this is permissible on the condition that a person does not regard its fast superior or more virtuous than other days in Shaʿbān. As mentioned above, fasting in Shaʿbān is sunnah and this includes the 15th. However, there is no specific virtue for fasting on this day and its virtue is equivalent to fasting any other day in Shaʿbān. As many people believe otherwise, it is advised not to fast solely on 15 Shaʿbān, though it is permissible in itself.

Third, ʿAllāmah Shurunbulālī (d. 1069/1659) has cited the narration of Sunan Ibn Mājah in Marāqī al-Falāḥ leading to a suggestion that he regards it mustaḥab. This is incorrect. He has cited the narration in the context of the virtue of the night as is clear. He has made no reference to the desirability of the sole fast of 15 Shaʿbān. Even if he did make a reference to it, he is a relatively recent scholar and his view alone cannot automatically represent the ḥanafī school particularly if it is based on an extremely weak narration. Likewise, Shaykh ʿAbd al-Ḥaq Muḥaddith Dehlawī (d. 1052/1642) has also cited the narration in one place. However, he has made no reference to the sole fast being sunnah or mustaḥab.

Fourth, the virtue of the night of 15 Shaʿbān is established in a number of narrations. This should not be confused with the status of the fast which is a separate matter.  

(2) The position of Muḥaddith al-ʿAṣr Shaykh al-Ḥadīth Mawlānā Muḥammad Yūnus Jownpūrī (d. 1438/2017)

Our respected teacher Mawlānā Muḥammad Yūnus Jownpūrī did not change his position before his demise. He has a detailed treatise on this subject as referred to above. The writer personally heard Shaykh commenting on this issue on 15 Shaʿbān 1438 shortly before his demise, clearly re-affirming his long-held stance. Before mentioning this, it is worth sharing the translation of an extract from his research on the matter from an earlier article:

“Our respected teacher Muḥaddith al-ʿAṣr Shaykh al-Ḥadīth Mawlānā Muḥammad Yūnus Jownpūrī writes in al-Yawāqīt al-Gāliyah (2:306):

‘The Ruling on the fast of 15 Shaʿbān: The fifth section is whether the fast of 15 Shaʿbān is an innovation. According to my knowledge, the earlier jurists have not mentioned this fast. There is no mention of this fast in the reliable mutūn (classical texts), nor in the available books of Imām Muḥammad ibn al-Ḥasan: Kitāb al-Aṣl, Jāmiʿ Ṣagīr, Kitāb al-Āthār, Kitāb al-Ḥujjah and Kitāb al-Siyar al-Kabīr. The later scholars have also not mentioned this fast. However, the general fast of Shaʿbān has been regarded as desirable. It is stated in Fatāwā ʿĀlamgīriyyah (1:103): “The desired fasts are various: first the fast of Muḥarram, second the fast of Rajab, third the fast of Shaʿbān. The fast of ʿĀshūrāʾ is on 10 Muḥarram according to the general scholars and companions. This has been mentioned in al-Ẓahīriyyah.” The evidence for the desirability of the general fast of Shaʿbān are those narrations that mention the extent to which the Prophet ﷺ would fast in this month, either the full month or most of the month, as has been mentioned above. Shaykh ʿAbd al-Ḥaq Muḥaddith Dehlawī has mentioned the desirability of the general fast of Shaʿbān in Sharḥ Sifr al-Saʿādah (p. 310). He has not mentioned the fast of mid Shaʿbān at all. In Ashiʿat al-Lamaʿāt (1:549) he has sufficed with the translation of the aforementioned narration of Ibn Mājah. Similarly, in Mā Thabata bi al-Sunnah (p. 199) he has sufficed with the mention of the narration of Ibn Mājah. The status of the narration of Ibn Mājah has been mentioned above. Similarly, this fast has not been mentioned in the available Ḥanbalī books such as Mukhtaṣar al-Khiraqī and its commentary al-Mugnī, or al-Muqniʿ and its commentary al-Shāfī. Similarly, there is no mention of this fast in the famous Shāfiʿī books such as Kitāb al-Umm of Imām Shāfiʿī, al-Muhadhdhab of Shīrāzī, Sharḥ al-Muhadhdhab of Nawawī, al-Minhāj, al-Manhaj and Tuḥfat al-Muḥtāj. However, ʿAbd al-Ḥamīd al-Shirwānī has indicated it is mandūb (desirable) in the commentary of Tuḥfat al-Muḥtāj. Similarly, there is no mention of this fast in the Mālikī books such as Mukhtaṣar al-Khalīl and its commentary Jawāhir al-Iklīl, or in Risālah Ibn Abī Zayd and its commentary Kifāyah al-Ṭālib, and neither in the commentary of Kifāyah by ʿAllāmah ʿAlī Ṣaʿīdī al-ʿAdawī.

For this reason, as the fast of 15 Shaʿbān does not have sufficient basis from a ḥadīth perspective, the statements of jurists do not provide any basis either. Most probably the jurists have remained silent because they disregarded the narration. As far as some later Shāfiʿī scholars who have mentioned it is mandūb or indicated towards that, it appears that they did not look at the chain of the narration, or if they did, they did not fully research it.

If the [fast of] 15 Shaʿbān is put aside, the general fast of Shaʿbān is established through ṣaḥīḥ (sound) and ḥasan (agreeable) narrations that have been outlined towards the end of the answer in section one of the answer. These narrations indicate that fasting in Shaʿbān without specifying [any particular day] is desirable, following the Prophet ﷺ. This is what the author of al-Ẓahīriyyah and other Ḥanafī jurists intended when they mentioned Shaʿbān from amongst the desirable fasts. Otherwise, they would have explicitly mentioned the fast of 15 Shaʿbān if that was intended.

Thus, the correct view now appears to be that specifying the fast of 15 Shaʿbān and solely fasting on that day is a Bidʿah (innovation) unless it is accompanied with the fast of 13 and 14, so that they become the fast of Ayyām Bīḍ.

After writing thus far, I found a passage in Fayḍ al-Qadīr (2:317) of ʿAllāmah Munāwī which holds the status of matn (principle text) for the aforementioned research: “Majd ibn Taymiyah said: There are sound narrations for the virtues of the fast of Shaʿbān. As regards the sole fast of mid Shaʿbān, there is no basis for this. In fact, it is detestable. He further said: Similarly, it is detestable to make it a festival in which food and sweets are cooked and adornments are made visible. This is from the innovated invented festivals that have no basis”. ʿAllāmah Munāwī has remained silent after citing this passage. It can therefore be deduced that he is in agreement with ʿAllāmah Majd al-Dīn ibn Taymiyyah.’ (Source: 15 Shaban: Virtue of the night and the status of the fast).

This clearly affirms Shaykh’s position on the matter. Shaykh did not change his stance before demise. The writer wrote the following on 15 Shaʿbān 1438 in the year Shaykh passed away, which should assist in clearing the confusion:

“Muḥaddith al-ʿAṣr Shaykh al-Ḥadīth Mawlānā Muḥammad Yūnus Jownpūrī said on Friday 15 Shaʿbān 1438 at 4.50pm at Darul Uloom Blackburn in response to a comment that people in Saudi Arabia do not pay attention to the fast of 15 Shaʿbān:

سنت سے کچھ ثابت نہیں ہے، سعودی والے صحیح کرتے ہیں۔ایک روایت ہے، لیکن ابو بکر بن ابی سبرۃ متہم بالوضع ہے۔ہر گز ۱۵ شعبان کا روزہ ایک بھی روایت سے ثابت نہیں ہے۔ صوفی لوگ زیادہ گڑبڑ کرتے ہیں۔آپ بچوں کا روزہ ہے اس لئے میں نے تو قضاء کی نیت سے روزہ رکھا ہے۔

Shaykh clearly mentioned that he is fasting qaḍāʾ and this also because he was given a false impression that people present were all fasting, this is not true, the vast majority of people were not fasting. Either way, Shaykh’s latest position on the issue is no different to what he has stated in al-Yawaqīt al-Gāliyah (2:307) which has been translated above; the summary is that specifying the fast of this day as sunnah or even mustaḥab is incorrect from a ḥadīth as well as fiqh perspective. This has been Shaykh’s position for more than two decades. We have personally heard Shaykh highlight his stance and research on at least ten different occasions over the past two decades during his visits to the UK and this is well known among his students and associates. One may disagree with this position in a scholarly manner, however, there is no need to misrepresent Shaykh’s view in this regard. It is also worth noting that fasting during Shaʿbān is highly recommended and this includes 15 Shaʿbān. Therefore, even if Shaykh had decided to fast a nafl (supererogatory) fast on 15 Shaʿbān and/or other days in Shaʿbān, this would not contradict his stance in any way. The contention is with singling out the fast of 15 Shaʿbān and regarding the fast more virtuous compared to other days in Shaʿbān based on the ḥadīth of Sunan Ibn Mājah. It is therefore important not to confuse the issue and convey Shaykh’s stance objectively and accurately when quoting him. Finally, Shaykh has highlighted that there is no mention of this fast in the books of Imam Muḥammad or the other ḥanafī texts. This is particularly relevant for those who attempt to justify this based on fiqh or taʿāmul (practice).” (Source: 15 Shaban: Virtue of the night and the status of the fast).

In conclusion, our respected teacher Shaykh Muḥammad Yūnus Jownpūrī did not change his firm and long-held view that specifying the fast of 15 Shaʿbān is not mustaḥab neither from a fiqh perspective, nor from a ḥadīth perspective.

عن عائشة رضي الله عنها قالت: كان رسول الله صلى الله عليه وسلم يصوم حتى نقول: لا يفطر، ويفطر حتى نقول: لا يصوم، فما رأيت رسول الله صلى الله عليه وسلم استكمل صيام شهر إلا رمضان، وما رأيته أكثر صياما منه في شعبان. وعنها قالت: لم يكن النبي صلى الله عليه وسلم يصوم شهرا أكثر من شعبان، فإنه كان يصوم شعبان كله، رواهما البخاري (١٩٦٩ و ١٩٧٠)۔

وقال السرخسي في المبسوط (٣/٩٢): ولا بأس بقضاء رمضان في أيام العشر يريد به تسعة أيام من أول ذي الحجة، وهو قول عمر رضي الله تعالى عنه. وكان علي رضي الله عنه يقول: لا يجوز لحديث روي عن رسول الله صلى الله عليه وسلم أنه نهى عن قضاء رمضان في أيام العشر. ونحن أخذنا بقول عمر رضي الله تعالى عنه، لأن الصوم في هذه الأيام مندوب إليه، وهو قياس صوم عاشوراء وصوم شعبان، وقضاء رمضان في هذه الأوقات يجوز، انتهى. فانظر إلى كلام السرخسي، خصص صوم عاشوراء بالذكر ولم يخصص صوم النصف من شعبان، مع أنه صح عن النبي عليه السلام أنه قال: أفضل الصيام بعد رمضان شهر الله المحرم، رواه مسلم (١١٦٣) من حديث أبي هريرة۔

وقال القاضي ظهير الدين محمد بن أحمد بن عمر البخاري المتوفى سنة ٦١٩ه كما في الجواهر (٢/٢٠) وتاج التراجم (ص ٢٣٢) في الفتاوى الظهيرية (ق ٥٨/أ): والمرغوبات من الصيامات أنواع: أولها صوم المحرم، والثاني صوم رجب، والثالث صوم شعبان. والرابع ستة أيام من شوال متتابعة. ويستحب متفرقة كل أسبوع يومان لطعن اليهود والنصارى، يقولون: رمضانكم أكثر من شهركم ورمضاننا كذلك. وتسمية الفساق والشبان هذه الأيام بالرمضان الصغير. وقال الإمام أبو بكر الإسماعيلي والفقيه محمد بن حامد رحمهما الله: التتابع فيه أفضل لتواتر الأخبار في ذلك. وقد ذكرنا أقوالا في صوم الست فيما تقدم. وكذلك صوم عشر ذي الحجة، وصوم عرفة لأهل الآفاق، وصوم يوم عاشوراء، وهو اليوم العاشر من المحرم عند عامة العلماء والصحابة. وقال ابن عباس: يصوم اليوم التاسع والعاشر والحادي عشر من المحرم. وصوم الأيام البيض، وهو اليوم الثالث عشر والرابع عشر والخامس عشر من كل شهر، وهو صوم توبة آدم عليه الصلاة والسلام، ابيضت نفسه بعد ما كانت اسودت، يصوم هذه الأيام فسميت أياما بيضا، لأن نفسه ابيضت بعد صوم هذه الأيام كل يوم بثلثه. وقال بعضهم وهو أحسن وأظهر وأبين: إنما سميت هذه الأيام الأيام البيض لأن هذه الأيام بلياليها بيض، وقد قال النبي صلى الله عليه وسلم: من صام ثلاث عشر ورابع عشر وخامس عشر فكأنما صام الدهر كله. وكذلك يستحب صوم يوم وإفطار يوم، وصوم الإثنين. وصوم يوم وإفطار يوم صوم داود النبي صلوات الله عليه. وصوم أيام الصيف لطولها وحرها أدب، انتهى۔

ووافقه في الفتاوى الهندية ونقله مختصرا، قال (١/٢٠٢): المرغوبات من الصيام أنواع: أولها صوم المحرم، والثاني صوم رجب، والثالث صوم شعبان، وصوم عاشوراء، وهو اليوم العاشر من المحرم عند عامة العلماء والصحابة رضي الله تعالى عنهم، كذا في الظهيرية، انتهى۔

وقد أطلت الكلام حول هذه المسئلة في تأليفي: إرشاد القاري إلى اختيارات شيخنا العلامة المحدث محمد يونس الجونفوري، أنقله منه بعض العبارات التي تدل على المقصود بتصرف يسير:۔

وأما ما رواه ابن ماجه (١٣٨٨) والفاكهي في أخبار مكة (٣/٦٦) والديلمي (١/٢٥٩) وأبو القاسم التيمي في الترغيب والترهيب (١٨٦٠) وعبد الغني المقدسي في الترغيب في الدعاء والحث عليه (٣٣) والمزي في تهذيب الكمال (٣٣/١٠٧) عن علي بن أبي طالب قال قال رسول الله صلى الله عليه وسلم: إذا كانت ليلة النصف من شعبان، فقوموا ليلها وصوموا نهارها، فإن الله ينزل فيها لغروب الشمس إلى سماء الدنيا، فيقول: ألا من مستغفر لي فأغفر له، ألا مسترزق فأرزقه، ألا مبتلى فأعافيه ألا كذا ألا كذا، حتى يطلع الفجر. فهو واه لا يحتج به لابن أبي سبرة. قال ابن الجوزي في العلل المتناهية (٢/٧١): هذا حديث لا يصح، انتهى. قال أحمد: ليس بشيء، كان يضع الحديث ويكذب. قال لي حجاج: قال لي أبو بكر بن السبري: عندي سبعون ألف حديث في الحلال والحرام. وقال ابن معين: ليس حديثه بشيء، قدم هاهنا فاجتمع الناس عليه، فقال: عندي سبعون ألف حديث إن أخذتم عني كما أخذ ابن جريج وإلا فلا. قيل ليحيى: عرض؟ قال: نعم. وقال ابن معين: ضعيف الحديث. وقال أيضا: ليس بشيء. وقال ابن المديني: كان ضعيفا في الحديث، وكان ابن جريج أخذ منه مناولة. وقال أيضا: كان منكر الحديث، هو عندي مثل ابن أبي يحيى. وقال إبراهيم بن يعقوب الجوزجاني: يضعف حديثه. وقال البخاري: ضعيف. وقال في موضع آخر: منكر الحديث. وقال النسائي: متروك الحديث. وقال ابن عدي: عامة ما يرويه غير محفوظ، وهو في جملة من يضع الحديث. كذا في تهذيب الكمال (٣٣/١٠٥) والميزان (٤/٥٠٣). وقال الحافظ في التقريب (ص ٦٢٣): رموه بالوضع، وقال مصعب الزبيري: كان عالما، انتهى۔

وقد أطال الكلام على الحديث وراويه شيخنا محمد يونس الجونفوري في اليواقيت الغالية (٢/٢٨٣) ومال إلى وضعه، وذكر أن أعلى أحواله أنه ضعيف جدا، والحديث إذا يكون فيه ضعف شديد لا يحتج به كما صرح به العلائي وابن حجر والسخاوي في القول البديع (ص ١٩٥) والسيوطي في التدريب (١/٣٥٠) وابن علان في الفتوحات الربانية (١/٨٣) وزكريا الأنصاري والخفاجي في شرح الشفا (١/٤٣) وشمس الدين الرملي والحصكفي في الدر المختار (١/١٢٨) والطحطاوي في حاشية الدر (١/٧٥) وابن عابدين (١/١٢٨) والجزائري واللكنوي في الأجوبة الفاضلة (ص ٥٥) ورشيد أحمد الجنجوهي في باقيات فتاويه (ص ٥٣٥) وإدريس الكاندهلوي في منحة المغيث (ص ٢١٤) وظفر أحمد العثماني في قواعد في علوم الحديث (ص ٩٢) وزاهد الكوثري في مقالاته (ص ٤٧) وعبد الفتاح أبو غدة وشيخنا في اليواقيت الغالية (٢/٣٠٣ و ١٤٦) وشيخنا محمد تقي العثماني في إنعام الباري (٢/١٧٧) وفتاويه (١/٢٣٠) وفضل الرحمن الأعظمي في شب برائت كي حقيقت بالأردية (ص ٢١ و ٢٨ و ٣٤)۔

وفي الباب عن علي قال: رأيت رسول الله صلى الله عليه وسلم ليلة النصف من شعبان، قام فصلى أربع عشرة ركعة، ثم جلس بعد الفراغ، فقرأ بأم القرآن أربع عشرة مرة، وقل هو الله أحد أربع عشرة مرة، وقل أعوذ برب الفلق أربع عشرة مرة، وقل أعوذ برب الناس أربع عشرة مرة، وآية الكرسي مرة، ولقد جاءكم رسول من أنفسكم، الآية. فلما فرغ من صلاته سألته عما رأيت من صنيعه، قال: من صنع مثل الذي رأيت كان له كعشرين حجة مبرورة، وصيام عشرين سنة مقبولة، فإن أصبح في ذلك اليوم صائما كان له كصيام سنتين سنة ماضية وسنة مستقبلة. رواه البيهقي في شعب الإيمان (٣٥٥٩) وقال: قال الإمام أحمد: يشبه أن يكون هذا الحديث موضوعا، وهو منكر، وفي رواته قبل عثمان بن سعيد مجهولون، انتهى. ورواه ابن الجوزي في الموضوعات (٢/١٣٠) وقال: هذا موضوع أيضا وإسناده مظلم، وكأن واضعه يكتب من الأسماء ما وقع له ويذكر قوما ما يعرفون، وفي الإسناد محمد بن مهاجر، قال ابن حنبل: يضع الحديث، انتهى. ووافقهم السيوطي في اللآلئ (٢/٥٠)۔

وممن جزم بعدم ثبوت صوم النصف من شعبان من علمائنا الحنفية المفتي رشید أحمد اللدهیانوي في تتمة أحسن الفتاوی والشیخ فضل الرحمن الأعظمي وشيخنا المفتي محمد تقي العثماني ووالدي المفتي شبیر أحمد۔

سمعت الوالد حفظه الله تعالی یقول غیر مرة: إفراد صوم نصف شعبان لا أصل له في الأحادیث ولا في أثار السلف، ولا نجد له ذكرا في زمن السلف ولا في كتب المتقدمین، وإنما شاع هذا الصوم في القرون الأخیرة في بعض البلاد. وقال أيضا: جاء شهر شعبان كل عام في زمن الرسول صلى الله عليه وسلم. فلو كان لصوم نصف شعبان فضل خاص لذكرها رسول الله صلى الله وعليه وسلم، ولعمل به الصحابة والتابعين، ولكانت الأحاديث فيه شائعة مستفيضة، انتهى۔

وسمعت شيخ الإسلام المفتي محمد تقي العثماني يقول ما تعريبه: لا يثبت حديث معتمد في إفراد صوم النصف من شعبان. وقال: لا يناسب صوم نصف شعبان خاصة معتقدا بأن له أجرا خاصا فوق أجر بقية أيام شعبان، انتهى۔

وقال المفتي رشيد أحمد اللدهيانوي في تتمة أحسن الفتاوى (١٠/٨٠) ما تعريبه: صوم هذا اليوم غير ثابت بأي حديث معتمد، وغير مذكور في أي كتاب من كتب الفقه. فلا يجوز الاعتقاد بسنيته أو استحبابه، انتهى۔

وقال المحدث الشيخ فضل الرحمن الأعظمي – وهو من تلاميذ المحدث الكبير الشيخ حبيب الرحمن الأعظمي – في تأليفه ’شب برائت كی حقیقت‘ أي حقيقة ليلة البراءة بالأردية (ص ٢٣) ما تعريبه: صوم النصف من شعبان غير ثابت بالأحاديث. وأخطأ بعض الناس الذين يزعمون أنه سنة، واغتروا برواية علي رضي الله عنه في سنن ابن ماجه، وهي غير معتمد بالكلية، انتهى۔

وقال شيخنا محمد يونس الجونفوري في اليواقيت الغالية (٢/٣٠٦) ما تعريبه: الجزء الخامس في صوم النصف من شعبان هل هو بدعة؟ فلم يذكره الفقهاء المتقدمون حسب علمي. لا ذكر له في كتب الإمام محمد بن الحسن المطبوعة: كتاب الأصل، والجامع الصغير، وكتاب الآثار، وكتاب الحجة، وكتاب السير الكبير. ولا ذكر له في المتون المعتبرة. وهكذا لم يصرح المتأخرون بصوم النصف من شعبان. نعم، ذكروا صوم شعبان مطلقا من المرغوبات. قال في الفتاوى العالمكيرية (١/١٠٣): المرغوبات من الصيام أنواع: أولها صوم المحرم، والثاني صوم رجب، والثالث صوم شعبان. وصوم عاشوراء هو اليوم العاشر من المحرم عند عامة العلماء والصحابة، كذا في الظهيرية، انتهى. والدلائل على استحباب صوم شعبان مطلقا هي تلك الأحاديث التي وردت فيها أن رسول الله صلى الله عليه وسلم كان يصوم في هذا الشهر كثيرا، وأنه كان يصوم كله وأحيانا أكثره كما تقدم. وقد ذكر الشيخ عبد الحق المحدث الدهلوي في شرح سفر السعادة (ص ٣١٠) استحباب صوم شعبان مطلقا، ولا ذكر فيه لصوم نصف شعبان. وفي أشعة اللمعات (١/٥٤٩) اكتفى بترجمة ابن ماجه على الحديث السابق. وهكذا اكتفى بحديث ابن ماجه في ما ثبت بالسنة (ص ١٩٩)، وقد عرفت حال هذا الحديث. وهكذا لا ذكر لهذا الصوم في كتب الحنابلة الموجودة (عندي): مختصر الخرقي، وشرحه المغني، وكذا المقنع وشرحه الشافي. وهكذا لا ذكر له في كتب الشافعية الشهيرة ككتاب الأم للشافعي، والمهذب للشيرازي، وشرح المهذب للنووي، والمنهاج، والمنهج، وتحفة المحتاج، غير أن عبد الحميد الشرواني أشار في حاشية تحفة المحتاج إلى ندبه. وهكذا لا ذكر له في كتب المالكية كمختصر خليل وشرحه حواهر الإكليل، ورسالة ابن أبي زيد وشرحه كفاية الطالب. ولم يذكره العلامة علي الصعيدي العدوي في حاشيته على الكفاية. وبالتالي، كما أنه لا يثبت إفراد صوم النصف من شعبان من ناحية الحديث، فكذلك لا ثبوت له في كلام الفقهاء. ويغلب على الظن أن الفقهاء سكتوا عنه لأن الحديث غير معتبر. وأما بعض المتأخرين من الشافعية الذين قالوا بندبه أو أشاروا إليه، الظاهر أنهم لم ينظروا إلى سند الحديث، وإن نظروا فلم يحققوا. وإن صرف النظر عن اليوم الخامس عشر، فصيام شعبان ثابتة بالأحاديث الصحيحة والحسنة التي تقدمت في نهاية الجواب للجزء الأول من السؤال، وبها يعلم أن صوم شعبان من غير تحديد مندوب اتباعا للنبي صلى الله عليه وسلم. وهذا هو مراد صاحب الظهيرية وغيره من فقهاء الحنفية الذين ذكروا صوم شعبان من الصيام المندوبة، وإلا لو كان مرادهم صوم نصف شعبان خاصة لصرحوا به. والآن يبدو أن الصواب هو أن تخصيص نصف شعبان وإفراد صومه بدعة، إلا أن يصام في اليوم الرابع عشر واليوم الثالث عشر لكي تكون صيام أيام البيض. وبعد أن كتبت إلى هذا المقام وجدت عبارة في فيض القدير (٢/٣١٧) للعلامة المناوي، وهي يحمل درجة المتن (والنص الأساسي) للتحقيق المذكور. قال: قال المجد بن تيمية: صوم شعبان جاء في فضلها أخبار صحيحة. وأما صوم يوم نصفه مفردا فلا أصل له، بل يكره. قال: وكذا اتخاذه موسما تصنع فيه الأطعمة والحلوى وتظهر فيه الزينة، وهو من المواسم المحدثة المبتدعة التي لا أصل له، انتهى. وسكت المناوي بعد نقل هذه العبارة، فيستنتج به أنه يوافق العلامة مجد الدين بن تيمية. انتهى كلام شيخنا۔

وقال شيخ الإسلام ابن تيمية في اقتضاء الصراط المستقيم (٢/١٣٨): أما صوم يوم النصف مفردا فلا أصل له، بل إفراده مكروه، وكذلك اتخاذه موسما تصنع فيه الأطعمة وتظهر فيه الزينة هو من المواسم المحدثة المبتدعة التي لا أصل لها، انتهى۔

وقال شهاب الدين الرملي في فتاويه (٢/٧٩) وقال: يسن صوم نصف شعبان بل يسن صوم ثالث عشره ورابع عشره وخامس عشره، والحديث المذكور يحتج به، انتهى. وهكذا استحبه الزرقاني المالكي في شرح المواهب (١٠/٥٦١) واحتج بالحديث. كما استحبه الدردير المالكي في الشرح الصغير (١/٦٩٢)، قال: (و) ندب صوم يوم (النصف من شعبان)، انتهى. وقال السامري الحنبلي في المستوعب (١/٤٢٦): ويستحب صوم رجب وشعبان وآكده يوم النصف من شعبان، انتهى. وذكره عنه المرداوي في الإنصاف (٣/٣٤٧) ولم يرجحه. وقال الشرواني في حاشية تحفة المحتاج (٣/٤٥٨): وكذا إذا وافق يوما طلب صومه في نفسه كعاشوراء أو عرفة ونصف شعبان، نهاية وسم، انتهى۔

وقال الحافظ ابن رجب في لطائف المعارف (ص ١٣٦)، قال: وأما صيام يوم النصف منه فغير منهي عنه، فإنه من جملة أيام البيض الغر المندوب إلى صيامها من كل شهر، وقد ورد الأمر بصيامه من شعبان بخصوصه، ففي سنن ابن ماجه بإسناد ضعيف عن علي عن النبي صلى الله عليه وسلم، وذكر الحديث۔

وقال العلامة ابن حجر المكي الهيتمي الشافعي في فتاويه (٢/٨٠)، قال: وأما صوم يومها فهو سنة من حيث كونه من جملة الأيام البيض، لا من حيث خصوصه، والحديث المذكور عن ابن ماجه ضعيف، انتهى. وهذا ككلام المناوي نص ضد من احتج من الشافعية بقول الرملي وعبد الحميد الشرواني. ثم لا بد من التنبيه على أن صيام أيام البيض تستحب في كل شهر لا في شهر شعبان فقط۔

فائدة مزيدة لم أذكرها في الرسالة المذكورة: ذكر الشرنبلالي حديث ابن ماجه في المراقي (ص ٤٠١) واستدل به على فضل ليلة النصف، ولم يذكر استحباب صوم يومه. وذكره للحديث لا يستلزم استحباب صوم يومه عنده، ولو كان مستحبا عنده لصرح به. ألا ترى إلى الجصاص في شرح مختصر الطحاوي (٧/٣١٦) والقدوري في التجريد (١٢/٦٣٢٥) والمرغيناني في الهداية (٤/٣٥٥) والزيلعي في تبيين الحقائق (٦/٢) وغيرهم ذكروا حديث أم سلمة: من أراد أن يضحي منكم فلا يأخذ من شعره وأظفاره شيئا، في ذكر بيان دلائل الشافعية لعدم وجوب الأضحية، وتأولوه، ولم يتعرضوا لحكم أخذ الشعر وتقليم الأظفار، إلا القدوري في موضع آخر (١٢/٦٣٤٤) فبسط الكلام وجزم بنفيه. فذكر الشرنبلالي الحديث لفضل إحياء ليلته لا يستلزم به استحباب صوم يومه، كما أن ذكر المرغيناني والزيلعي للحديث لا يستلزم به استحباب الإمساك عن تقليم الأظفار وأخذ الشعر عندهما، وقد ذكرت في بعض أجوبتي حديثا أن استحباب الإمساك ليس بمسلك الحنفية أصلا. ولئن سلمنا أن الشرنبلالي مال إلى استحبابه فهو في ذلك كالرملي والشرواني والزرقاني والدردير وجماعة من مشايخنا ببلاد الهند كأشرف علي التهانوي في بهشتي زيور (الحصة السادسة، ص ٣٥١) وعزيز الرحمن العثماني في فتاويه (٦/٣٠٩) ومحمد شفيع العثماني ومحمود حسن الجنجوهي في فتاويه (١٥/٢٢٦) وغيرهم. وكلهم استأنسوا بالرواية المذكورة، وهي ضعيفة جدا، ولم يحققوا سندها كما تقدم من كلام شيخنا. وقد تصدى بعض المعاصرين لتقوية الحديث ولم يذكروا الجرح في راوي الحديث، ومالوا إلى أنه ضعيف وأن الحديث ضعيف مقبول، وهذا منهم عجيب. ولو سلمنا أن سنده ضعيف لا واه، فمتنه منكر. ثم استأنسوا بما ذكره بعض الشافعية كالرملي، لكنهم لم يتعرضوا لما ذكره المناوي وابن حجر المكي، ومن العجب أنهم ذكروا بعض كلام ابن حجر المكي وليس فيه تصريح الندب، ولم يذكروا كلامه المذكور في هذا الجواب. ثم ذكروا استحباب الصوم عن ابن رجب، وقد تقدم كلامه ولم يصرح باستحبابه. وهكذا نقلوا استحبابه عن المرداوي، ولم يقل المرداوي باستحبابه، وإنما نقل كلام السامري المذكور ولم يرجحه كما تقدم. فاحفظ كل هذا واسلك سبيل المنصفين۔

فائدة ثانية: قال النووي في شرح مسلم (٨/٣٩): لم يثبت في صوم رجب نهي ولا ندب لعينه ولكن أصل الصوم مندوب إليه، وفي سنن أبي داود أن رسول الله صلى الله عليه وسلم ندب إلى الصوم من الأشهر الحرم ورجب أحدها، انتهى. وقال ابن تيمية في فتاويه (٢٥/٢٩٠): وأما صوم رجب بخصوصه فأحاديثه كلها ضعيفة بل موضوعة، لا يعتمد أهل العلم على شيء منها، وليست من الضعيف الذي يروى في الفضائل بل عامتها من الموضوعات المكذوبات. وقال: وفي المسند وغيره حديث عن النبي صلى الله عليه وسلم أنه أمر بصوم الأشهر الحرم، وهي رجب وذو القعدة وذو الحجة والمحرم. فهذا في صوم الأربعة جميعا لا من يخصص رجبا، انتهى. وقال ابن عبد الهادي في جزءه في الأحاديث الضعيفة التي يتداولها الفقهاء وغيرهم المطبوع في مجموع رسائله (ص ١١٠): وكذلك الأحاديث المروية في فضل شهر رجب بخصوصه أو فضل صيامه أو صيام شيء منه أو فضل صلاة مخصوصة فيه كالرغائب كلها كذب، انتهى. وقال ابن رجب في لطائف المعارف (ص ١١٨): وأما الصيام فلم يصح في فضل صوم رجب بخصوصه شيء عن النبي صلى الله عليه وسلم ولا عن أصحابه، ولكن روي عن أبي قلابة قال: في الجنة قصر لصوام رجب. قال البيهقي: أبو قلابة من كبار التابعين لا يقول مثله إلا عن بلاغ. وإنما ورد في صيام الأشهر الحرم كلها حديث مجيبة الباهلية عن أبيها أو عمها أن النبي صلى الله عليه وسلم قال له: صم من الحرم واترك، قالها ثلاثا. خرجه أبو داود وغيره. وخرجه ابن ماجة وعنده: صم أشهر الحرم. وقد كان بعض السلف يصوم الأشهر الحرم كلها منهم ابن عمر والحسن البصري وأبو اسحاق السبيعي. وقال الثوري: الأشهر الحرم أحب إلي أن أصوم فيها، انتهى. وقال الحافظ ابن حجر في تبيين العجب بما ورد في شهر رجب (ص ٢٣) وحكاه الحطاب في مواهب الجليل (٢/٤٠٨): لم يرد في فضل شهر رجب ولا في صيامه ولا في صيام شيء منه معين ولا في قيام ليلة مخصوصة فيه حديث صحيح يصلح للحجة. وقد سبقني إلى الجزم بذلك الإمام أبو إسماعيل الهروي الحافظ، رويناه عنه بإسناد صحيح، وكذا رويناه عن غيره، انتهى. ثم ذكر الحافظ حديث أبي داود المذكور وقال (ص ٣٠): ففي هذا الخبر وإن كان في إسناده من لا يعرف ما يدل على استحباب صيام بعض رجب، لأنه أحد الأشهر الحرم، انتهى۔
