Answered as per Hanafi Fiqh by HadithAnswers.com

Is there a hadith that says drop the corporal punishment (hadd) where there is doubts? I heard its in Tirmidhi can you show me the hadith please and is it sahih?

Answer

Sayyiduna ‘Abdullah ibn ‘Abbas (radiyallahu’anhuma) reports that Rasulullah (sallallahu’alayhi wasallam) said:

Avert (enforcing) corporal punishment (hadd) in the presence of doubt

(This hadith is recorded with an authentic chain in Musnad Abu Hanifah, 157-Tansiqun Nizam. See footnotes of my Esteemed Teacher; Al-Muhaddith Shaykh Muhammad ‘Awwamah-may Allah protect him- on Musannaf Ibn Abi Shaybah, before hadith: 29087, Atharul Hadith, pg.213 & Al-Maqasidul Hasanah, hadith: 46)

There is further support for this in Sahih Bukhari, hadith: 6824. See: Atharul hadith, pg.212)

The narration you requested from Sunan Tirmidhi is slightly different. Hadith: 1424.

And Allah Ta’ala Knows best,
