Refraining from Fasts of Ramadhaan, but Fasting on Ashurah

Asalamu’alaikum

Question: What is the ruling regarding the one who has days of fasting remaining from the monthof Ramadhaan yet wishes to fast voluntary fasts or fast the day of ‘Aashooraa. (tenth day of Muharram)? For example, he wants to fast both the tenth and eleventh days with the intention of making up (the missed fasts of Ramadhaan) and not the fast of the day of ‘Aashooraa. Also, is it permissible for one to fast the day of ‘Aashooraa., even if he has fasts to make up from the month of Ramadhaan? And is it permissible for one who has days to make up from Ramadhaan to fast the Day of ‘Aashooraa and the day before it or the day after it, with the intention of making up (what he has missed)?

Answer

Wa’alaykum as Salām wa raḥmatullāhi wa barakātuhu,

Since no one knows when he is going die, it is best for a person to keep his qadhā fasts as soon as possible. However, if a person delays the fasts and keeps them on the days of sunnah/nafilfasts (like 10th Muḥarram etc), it will be fine. Likewise, if instead of keeping the qadhā, if a person opts to rather keep sunnah/nafil fasts, then that will also be correct.


وإن أخره حتى دخل رمضان آخر صام الثاني لأنه في وقته وقضى الأول بعده لأنه وقت القضاء ولا فدية عليه لأن وجوب القضاء على التراخي (الهداية شرح البداية

و حكى القدوري عن الكرخي أنه كان يقول في قضاء رمضان أنه مؤقت بما بين رمضانين و هذا غير سديد بل المذهب عند أصحابنا أن وجوب القضاء لا يتوقت لما ذكرنا أن الأمر بالقضاء مطلق عن تعيين بعض الأوقات دون بعض فيجري على إطلاقه و لهذا قال أصحابنا : إنه لا يكره لمن عليه قضاء رمضان أن يتطوع و لو كان للوجوب على الفور لكره له التطوع قبل القضاء لأنه يكون تأخيرا للواجب عن و قته المضيق و أنه مكروه و على هذا قال أصحابنا : أنه إذا أخر قضاء رمضان حتى دخل رمضان آخر فلا فدية عليه (بدائع الصنائع – (2 / 265)
