Sacrificing animals for Hujjaj

Answered as per Hanafi Fiqh by DaruliftaaZambia.com

Question

As Salamu alaykum

Dear respected mufti

Please share some light on the sacrificing of animals for hujjaj.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

There are two parts to your query:

  • Sacrificing an animal as Dum (gratitude for being able to perform the rites of Hajj and Umrah in one trip).[1]
  • Sacrificing an animal for Qurbani (Udhiyyah).
  • If a person is performing a Qiraan and Tamattu’ Hajj (Umrah and Hajj performed in one Ihraam and two Ihraams, respectively), one Dum-e-Shukr is Wajib.

If one is performing Ifraad Hajj (Hajj only), one Dum-e-Shukr is Mustahab. [2]

A Dum-e-Shukr refers to the slaughtering of a small animal e.g. sheep/goat or one-seventh share of a big animal e.g. camel/cow/ox/buffalo within the boundaries of the Haram. The rulings of animals of Qurbani also apply to the animal of Dum-e-Shukr.[3]

  • As far as Qurbani for a Haaji is concerned, then this is dependent on whether he/she is a Muqeem in Makkah or not.[4] In this regard, the Darul Iftaa adopts the view that Azizia is part of Makkah whilst Mina, Muzdalifah and Arafat are not part of Makkah.

Hence, a person whose collective stay in Makkah and Azizia till the 8th of Zul Hijjah exceeds 14 days, then Qurbani of Eid will be Wajib on him, taking into consideration that he is in possession of wealth that is equal to or above the Nisaab of Qurbani. This Qurbani is in addition to the Dum of Shukr. It may be performed within the boundaries of the Haram, in one’s country or elsewhere.

A person whose collective stay in Makkah and Azizia till the 8th of Zul Hijjah is less than 14 days will not be required to perform Qurbani of Eid.[5]

Generally, the obligation of performing Qurbani applies to those Hujjaaj who travel on five week packages.

And Allah Ta’āla Knows Best
