Is it permissible to sell lottery tickets?

Question

Is it permissible to sell lottery tickets in the shop?

Because the man is saying he doesn’t use that money for his needs rather he sends it to India to build toilets and stuff for poor.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Shari’ah advocates that every step that a Muslim takes in his commercial endeavors be in accordance with Shari’ah. It is not merely the outcome that matters. Rather, the procedure in which any commercial activity – whether profitable or not – is carried out is equal in importance to the outcome of that activity.

Whilst the man’s intention is noble, it is incorrect to commit a sinful act to perform a virtuous deed. For example, it is incorrect for one to steal with the intention of feeding the poor and needy with the stolen money.

Gambling and selling lottery tickets is strictly prohibited in Islam. The proceeds of gambling are also Haraam.[1]

Consider the following Aayaat:

يا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنْصابُ وَالْأَزْلامُ رِجْسٌ مِنْ عَمَلِ الشَّيْطانِ فَاجْتَنِبُوهُ لَعَلَّكُمْ تُفْلِحُونَ

Translation: O you who have Imaan! Indeed liquor (wine, beer and other intoxicants), gambling, Idols and (distribution by) arrows are filth (vile acts) from the acts of Shaitaan, so abstain from them so that you may be successful (gain salvation in both worlds).

(Surah Al-Maaidah, Aayah 90)

 

يَسْأَلُونَكَ عَنِ الْخَمْرِ وَالْمَيْسِرِ قُلْ فِيهِمَا إِثْمٌ كَبِيرٌ وَمَنَافِعُ لِلنَّاسِ وَإِثْمُهُمَا أَكْبَرُ مِنْ نَفْعِهِمَا

Translation: They question you about (the permissibility of) liquor and gambling.

Say, in both is great sin (because of their ill effects) and some benefits for some man, but the sin is far greater than their usefulness.

(Surah Al-Baqarah, Aayah 219)

أَنَّ أَبَا هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ “‏ مَنْ حَلَفَ مِنْكُمْ فَقَالَ فِي حَلِفِهِ بِاللاَّتِ وَالْعُزَّى‏.‏ فَلْيَقُلْ لاَ إِلَهَ إِلاَّ اللَّهُ‏.‏ وَمَنْ قَالَ لِصَاحِبِهِ تَعَالَ أُقَامِرْكَ‏.‏ فَلْيَتَصَدَّقْ ‏

Translation: Nabi () said, “Whoever among you takes an oath wherein he says, ‘By Al-Lat and Al-`Uzza,’ names of two Idols worshipped by the Pagans, he should say, ‘None has the right to be worshipped but Allah; And whoever says to his friend, ‘Come, let me gamble with you ! He should give something in charity.

(Saheeh Al-Bukhari)

The questioner understands that it is prohibited to deal in gambling. Likewise, selling lottery tickets is also prohibited as this is directly assisting in the sin of gambling and betting, even though one does not benefit from the proceeds of the tickets.

Allah Taalah says:

وَلَا تَعَاوَنُوا عَلَى الْإِثْمِ

Translation: “And do not assist one another in sin”

(Surah Al-Maaidha, Aayah 2)

Nabi (ﷺ) said,

ومن دعا إلى ضلالة كان عليه من الإثم مثل آثام من يتبعه

Translation: “Whoever calls (or is a means) to misguidance, he will have the sin equivalent to the one who follows it.” (Jaami Al-Tirmidhi)

May Allah Taala grant him halaal income and keep him away from haraam. Aameen.

(من جانب واحد وحرم لو شرط) فيها (من الجانبين) لأنه يصير قمارا (إلا إذا أدخلا ثالثا) محللا (بينهما) (إن شرط المال) في المسابقة

(قوله من الجانبين) بأن يقول إن سبق فرسك فلك علي كذا، وإن سبق فرسي فلي عليك كذا زيلعي وكذا إن قال إن سبق إبلك أو سهمك إلخ تتارخانية (قوله لأنه يصير قمارا) لأن القمار من القمر الذي يزداد تارة وينقص أخرى، وسمي القمار قمارا لأن كل واحد من المقامرين ممن يجوز أن يذهب ماله إلى صاحبه، ويجوز أن يستفيد مال صاحبه وهو حرام بالنص، ولا كذلك إذا شرط من جانب واحد لأن الزيادة والنقصان لا تمكن فيهما بل في أحدهما تمكن الزيادة، وفي الآخر الانتقاص فقط فلا تكون مقامرة لأنها مفاعلة منه زيلعي
