Employee receiving commission directly from the suppliers

Question

Slms. Most shops have sales promoters whereby they sell phones and get commission depending on the phones they sell. My shop dosent have a promoter and what the suppliers have started is we keep record of the phones we sell and suppliers pay us the commission direct. In this case can I get the commission or it belongs to the shop? If I don’t provide them with the record they wont pay us that commission.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

At the outset it is important to clarify whether the suppliers are aware that your shop has no sales promoter. If the suppliers are unaware of this, then they should be informed of this. If they are unhappy with paying a commission without a sales promoter, then it is their right to withhold the commission.

However, if they are aware of this and are still willing to pay the ‘commission’, then this commission can be accepted by the business. The commission in both scenarios belongs to the owner of the shop.

In terms of Shari’ah, an employee is deputed to enact transactions on behalf of his employer. Therefore, in the enquired scenario, the employee will not be entitled to the commission earned on the phones he sells on behalf of the owner. He is responsible to hand over the commission to the employer. If he has kept any amount of commission by himself till now, it has to be returned back to the owner.[i] However, the employee may request the employer to consider giving him the commission if he makes an extra effort in promoting the sales of those particular products.

بعض دکاندار کمپنی کے ملازم سے معاہدہ کرتے ہیں اگر آپ  کمپنی کا سامان ہم سے خریدیں گے ہم آپ کو اتنے فیصد رعایت دیں گے،تو ملازم کے لئے یہ کمیشن رکھ لینا شرعا جائز ہوگا یا نہیں؟

جواب: یہ کمیشن کے نام سے سامان کی قیمت میں رعایت ہے جو کمپنی کا حق ہےکیوں کہ اگر وہ کمپنی کے لئے نہ خریدتے تو اتنے کی اس کو نہیں ملتی تو معلوم ہوا کہ یہ اس شخص کا کمیشن نہیں بلکہ زیادہ سامان خریدنے کی وجہ سے سامان پر رعایت ہے،لہذا ملازم پر لازم ہے اصل قیمت کمپنی سے وصول کرے اور رعایت کمپنی کو واپس کردے اگر اب تک اپنے پاس ہی رکھتا رہا تو اتنی رقم حساب کرکے کمپنی میں جمع کرانا لازم ہے۔
