An Inheritance Situation

My father died 12/11/12 leaving behind 3 sons 2 daughters and a wife. He had 10 properties on rent as a business, how do we share the business/properties as the wife and brothers have taken everything and shared nothing with the sisters,1 of which is married with 2sons.we were all close to our father he died suddenly.

In the name of Allah, the most Beneficent, the most Merciful.

Answer

The deceased’s total estate will be distributed in the following way:

8/ 64                                                                                                      8

Wife                       3 Sons     (8)     2 Daughters

8                             14 each         56       7 each

In the aforementioned scenario, the deceased’s property will be distributed into 64 shares. The wife will receive 8 shares from the total estate. Each of the three sons will receive 14 shares and each of the daughters will receive 7 shares.

The brothers and the wife should be encouraged to hand over the shares to the sisters which she is worthy of.
