If Zakat money is stolen?

I wanted to ask you that if a person was carrying a purse and it contained money, which the person had separated for sadakah. And then that purse had got stolen is fully confirmed stolen. In this case does the person have to take out that same amount of sadkah to replace that sadkah which got stolen?

In the name of Allah, the most beneficent, the most merciful.

Answer:

Sadkah is of three types.

(1) Fardh e.g. Zakah. (2) Wajib e.g. nazar and sadkah-e- fitr. (3) Nafal e.g. normal donations.

If the money separated was of the first two categories (Fardh & Wajib) then it will be necessary to replace the money and pay sadkah otherwise not. Sadkah is not considered as paid by mere separation but when it actually comes into the ownership of the poor and needy.

It is stated in Durrul Mukhtar that, “one’s responsibility of paying Zakat will not be fulfilled by setting aside the money, but rather by distributing it upon the poor and needy.” (Vol 2, P13)
