Qasr when in Mina

Question


We arrived in Makkah just after midnight on 29/7 (we are here for 7 days. We go to aziziya on 4th August then Mina for 5 days of hajj. And then back to Aziziya after hajj till the 17th of August. Are we praying qasr or full namaz?


I. E. :


28/7 – 5/8  in makkah


5/8 – 9/8  in aziziya


9/8 – 14/8  in Mina/muz/Arafat


14/8 – 17/8  in aziziya After hajj


Are we doing qasr in makkah or full?

In such a case on Hajj when one intends to stay over 15 days within the designated places of Hajj there will be Qasr. This is because arriving in Makkah for Hajj although he is intending to stay there for over 15 days the intention will be contrary to the reality, since apart of hajj will consist of necessary travel to the places you have mentioned, such as Aziziya, Mina, Arafah, and more. Due to this reality, the intention of the pilgrim will not remove the status of travelling from them and they will be performing prayer as a traveller.

ذَكَرَ فِي كِتَابِ الْمَنَاسِكِ أَنَّ الْحَاجَّ إذَا دَخَلَ مَكَّةَ فِي أَيَّامِ الْعَشْرِ وَنَوَى الْإِقَامَةَ نِصْفَ شَهْرٍ لَا تَصِحُّ؛ لِأَنَّهُ لَا بُدَّ لَهُ مِنْ الْخُرُوجِ إلَى عَرَفَاتٍ فَلَا يَتَحَقَّقُ الشَّرْطُ وَقِيلَ: كَانَ سَبَبُ تَفَقُّهِ عِيسَى بْنِ أَبَانَ هَذِهِ الْمَسْأَلَةَ وَذَلِكَ أَنَّهُ كَانَ مَشْغُولًا بِطَلَبِ الْحَدِيثِ قَالَ: فَدَخَلْتُ مَكَّةَ فِي أَوَّلِ الْعَشْرِ مِنْ ذِي الْحَجَّةِ مَعَ صَاحِبٍ لِي وَعَزَمْتُ عَلَى الْإِقَامَةِ شَهْرًا فَجَعَلْتُ أُتِمُّ الصَّلَاةَ فَلَقِيَنِي بَعْضُ أَصْحَابِ أَبِي حَنِيفَةَ – رَحِمَهُ اللَّهُ تَعَالَى – فَقَالَ: أَخْطَأْتَ فَإِنَّكَ تَخْرُجُ إلَى مِنًى وَعَرَفَاتٍ فَلَمَّا رَجَعْتُ مِنْ مِنًى بَدَا لِصَاحِبِي أَنْ يَخْرُجَ وَعَزَمْتُ عَلَى أَنْ أُصَاحِبَهُ وَجَعَلْتُ أَقْصُرُ الصَّلَاةَ فَقَالَ لِي صَاحِبُ أَبِي حَنِيفَةَ – رَحِمَهُ اللَّهُ تَعَالَى -: أَخْطَأْتَ فَإِنَّكَ مُقِيمٌ بِمَكَّةَ فَمَا لَمْ تَخْرُجْ مِنْهَا لَا تَصِيرُ مُسَافِرًا فَقُلْتُ أَخْطَأْتُ فِي مَسْأَلَةٍ فِي مَوْضِعَيْنِ فَرَحَلْتُ إلَى مَجْلِسِ مُحَمَّدٍ – رَحِمَهُ اللَّهُ تَعَالَى – وَاشْتَغَلْتُ بِالْفِقْهِ، كَذَا فِي الْبَحْرِ الرَّائِقِ.


 


وَلَوْ نَوَى الْإِقَامَةَ خَمْسَةَ عَشَرَ يَوْمًا فِي مَوْضِعَيْنِ فَإِنْ كَانَ كُلٌّ مِنْهُمَا أَصْلًا بِنَفْسِهِ نَحْوَ مَكَّةَ وَمِنًى وَالْكُوفَةِ وَالْحِيرَةِ لَا يَصِيرُ مُقِيمًا وَإِنْ كَانَ أَحَدُهُمَا تَبَعًا لِلْآخَرِ حَتَّى تَجِبَ الْجُمُعَةُ عَلَى سُكَّانِهِ يَصِيرُ مُقِيمًا.
