Kinaya words used for divorce

Question:

I’d like to ask whether the following would constitute a talaq. If a husband says the word ‘Recharge’ or ‘Macho’ aloud and in his heart, he has the intention of divorce, does this take effect?

At the time of saying them, he did not know that these words can be metaphoric for divorce.

Your help would be much appreciated as it is causing the person great distress. Also, if possible, can this not be posted on the website

 


 


بِسْمِ اللهِ الرَّحْمنِ الرَّحِيْم


In the name of Allah, the Most Gracious, the Most Merciful.

The words ‘Recharge’ and ‘Macho’ have nothing to do with divorce, nor can they be used metaphorically to imply divorce; therefore, they will not constitute a divorce.[1]

And Allah SWT alone knows best.
