Is fixed profit investment halal or haram according to Quran and Hadith?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
My question is this if anyone invests money with any person or company, usually people say that profit is never fixed because in Islam fixed profit is haram for example I invest one lakh with any person or company and we both are agreed that he will give me 4000 per month. Is this halal or haram? If haram, then kindly give answer with reference to the holy Quran and Hadith.

Answer

(Fatwa: 1263/788/L=1433)

It is not lawful to receive fixed profit in partnership. Hence it is not lawful to take 4000 rupees each month after giving one lakh. If you want to do the dealing in partnership then it shall be necessary to fix the profit on percent i.e. in case of profit so and so percent shall be for so and so person, and in case of loss so and so percent of loss will be born from capital amount. It is not lawful in any case to receive only fixed profit (whether the profit is less or more) and not sharing the loss.
