Is our marriage valid according to Islamic Shariah if we do nikah and court marriage without our parents’ consent?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
I am 34 years old sunni Muslim boy and I want to marry a 31 years old Muslim sunni girl she also wants the same. I approached her family through proper way but they refused it more than three times. They say that they belong to higher caste. They beat her daughter since 4 years to forget that boy. Now our age is crossing. We both decided to do nikah without parents and also to do court marriage. Is our marriage valid or is there any other way? We both do not want to leave each other. Please suggest us according to Islamic Shariah.

It is better for both of you not to go ahead with the marriage yourselves. And whenever you need nikah you should do nikah on Shariah pattern that is masnoon and common. Court marriage is not the Shariah way of nikah. However, though it is right if adult and wise Muslim male and female do nikah as per Shariah it shall be valid. The consent of parents is not necessary for nikah to take place, but it is hoped that without their consent there might crept misfortune. Also if the nikah is done in non-kufu the father of the girl shall have the right to revoke the nikah.
