How long is her iddat & how can she take her son to hospital if she’s the only one who can?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
My sister was married for 3 years. since the start of the marriage her husband has not provided for her or treated her well. her husband was in pakistan and she came back to uk after 3 months. she had a babywho is ill and has to go hospital 3/4 times a week. last year she went to her husband for a month and came back. all the time he has fought with her. a few days ago he sent her talaq letter with three talaqs. what is her iddat and how does she take her son to hospital because she is only one who can. please answer as soon as possible?

Answer

(Fatwa: 1182/1175=J)

If the talaq-letter is written by the husband or the husband signed it after listening it, then her wife is divorced with three talaqs and now she has to stay in iddah (waiting period). If the divorcee is not pregnant she has to observe iddah of three menstruation period; after passing three menstruation cycles from the talaq onwards her iddah will come to an end: والمطلقات یتربصن بانفسھن ثلاثۃ قروء (الآیۃ)

As far as taking her son to hospital is concerned it should be done by her brother or any nearest relative. However, in case of emergency she can take her son to hospital for treatment:

واما الخروج للضرورۃ فلا فرق بینھما کما نصوا علیہ (الدر المختار: 5/445، ط زکریا)
