Is the ‘Talaq’ valid? If not, can I take back my wife? How long is the iddath period?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Over 7 years I am living in gulf but I usually come to India twice to stay over 35days in a year. Although I was not happy, but due to both family sides?? sentiments and forced from both families I had bended my head and got forced married in 2007. But, in the month of August5, while I was communicating with my wife over telephone I become anger and pronounced thrice the word ?? Talaq?? at the same time.. is this ??Talaq?? made us separated or its not valid? In case, if it?’s not valid can I take back her? Incase of if I would like to reconsider my decision, how much time i mean what is last day of iddath period is it exactly 3 month or more can be consider.. I would appreciate if you please reply as soon as possible as the time is so short..

Answer

(Fatwa: 187/189=L)

If you have spent time with your wife in privacy, then in the abovementioned case the three talaqs took place and your wife was divorced with mughalllaza (irrevocable) talaq and now you cannot rejoin without Sharai Halalah, as the Quran says: فان طلقھا فلا تحل لہ من بعد حتی تنکح زوجاً غیرہ (الآیۃ)

Now, she will have to sit in iddah (waiting) period, she can marry a man after the iddah is over. If he is divorced again by this husband and spends iddah period, then she can marry his first husband.
