Can she get a Khula without me present?

Janab, Most humbly and requestfully I beg you to ask that; I got married at 4th of august 2010 without the involvement of guardian with a muslim girl. We too are adult; I have a Nikahnama from Madarsa. After 20 days her parents came at my place in mumbai and biforcely they approached my begum in my absence and came at their place with her. So my question are…… 1. Can her family is elidgible to take Khula withot my presence? 2. Without Khula , is she elidgible to get married? 3. I have no contact with her; Am i elidgible to take legal actions with her family, if yes then how?

(Fatwa: 114/95/L=1432)

(1 & 2) Your nikah was valid if you solemnized it in the presence of at least two witnesses. She cannot marry other man until you do not divorce her or she gets khula’. The consent of spouse (husband and wife) is necessary for khula’, khula cannot take place without your (husband’s) consent.
(3) You should not take any legal procedure rather you should try to solve it with mutual understanding. If there is no way left for conciliation, it is better to give her one talaq so that she could marry to someone else after passing iddah period and she had not to stay with her parents aimlessly.
