Is it permissible according to Islamic law to gift my house only to my 4 sons, who take care of me and my wife?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Assalamu alikum Iam 76 year old muslim.I have 8 childrens totally. 4 men and 4 women. As per islamic law and indian custom i have completed my 4 daughters marriage in a grand manner(with 500 gms gold). My three son have been married and my younger son is a bachelor(till now).Me and my wife live with my sons.We all live togather in my own earned house. My sons cleared my debts when i lost my business.I gifted my house only to my 4 sons because this is the only place where my sons and my daughter-in-laws(with their childrens) live and they take care of me and my wife.Is this correct according to Islamic law. please clear my doubt. Jazakallah

Answer

(Fatwa: 2296/1886=B/1429)

It is mentioned in Hadith:

اتقوا اللہ واعدلوا بین أولادکم

Fear Allah and do justice with your children (in giving gifts).

This Hadith says if a father wants to distribute his property in his life among his children he should give equal shares to everyone whether son or daughter. It is sin not to give equal share to daughters without any valid reason. It is better to evaluate the house and distribute it equally between each and give their shares in their possession.
