Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Salaams In the light of Sharia please kindly provide answer to the following question After the passing away of my father, who is entitled to his assests and in what proportions. He left behind a wife, one brother, one sister, five sons and three sisters.would any one else be entitled. Jazakallah May Allah reward your services.

Answer

(Fatwa: 1041/1041=M/1429)

If none of the parents of your father was alive at the time of his death, then his wife and children shall inherit his wealth, but his brothers and sisters shall get nothing. In the case mentioned above, after all due rights preceding inheritance, the entire property and wealth left by the father shall be distributed in 104 shares; out of which 13 shares will go to his wife, 14 shares to each son (*5= 70 shares) while 7 shares shall go to each daughter (*3=21 shares).
