Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Assalam o alaikum , Mufti sahab, I have a question about inheretance. My father died many years back but we got some property from his share of family land 4 years back. The said property has to be distributed amongst wife( my mother ) and 2 sons ( me and my younger brother ): The chain is given below : 1. MY MOTHER 2. My younger brother who is married but with no children. 3. Myself , married with wife and 3 daughters. Can you please advice the share of each in the light of the Quran and Hadith. Jazaak allah o khair. Asif =– 3. My self.

Answer

(Fatwa: 1016/896=L/1429)

If your grandparents were not alive at the time of your father’s death, also you do not have any sister, then after paying all due rights proceeding inheritance, the property left by your father shall be divided in this way; the eighth part of the property shall go to your mother while the rest shall be distributed among you two brothers equally.
