Is it permissible for an organisation to take a profit from qurbani without disclosing the amount?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
Bismihi Ta`ala Assalamoualaikoum, this istifta is being asked by the Jamiat ul Ulama of Mauritius to your dar ul ifta as per the qurbani made in India for Mauritians. 1. The muslims habitants of Mauritius entrust their qurbani to some particular organisation. The organisation carry out the qurbani in India and promise them to bring back 30 pounds of meat in Mauritius. Can that organisation take a profit over that without disclosing the amount he is taking? 2. The meat in the abbatoir are mixed. Hence the person offering qurbani do not receive bi`ainihi his meat. Is this not analogous to bai` luhmul adahi? 3. In due purchase of the cow, a discount is being given in exchange of the skin. As such after the qurbani, the skins are to be left in the abatoirs. Is this permissible? This istifta is of utmost priority. JazaakAllah Khairan A.I.Mackoojee Secretary

Answer

(Fatwa: 2572/1930=H/1429)

(1) Your question is unclear, which amount does not the organization want to make known and want to take benefit from? And the benefits are achieved? Does not the organization cheat anyone in this dealing?

(2) The mentioned organizations are appointees (wakil) of those wishing to perform Qurbani. If they have given those organizations authority regarding meat, then it is allowed for the organizations to mix the Qurbani meat and distribute it as per the wishes of the people doing Qurbani. This is neither a type of selling Qurbani meat nor similar to it.

(3) This is not lawful. It can be allowable thus that people doing qurbani should tell the organization to purchase animals without skin-dealing and sacrifice them on their behalf. After sacrificing the animals, when the skin is peeled off, any persons is appointed wakil to sell the skins, (no matter if this person is a member of the organization). The appointee will sell the skins (though to the organization) and spend the money according to the wishes of people doing qurbani.
